Exporters who imported inputs without paying integrated tax and compensation cess under the advance authorisation and export oriented unit exemption notifications were barred by Rule 96(10) from claiming refund of integrated tax paid on exports. The Board clarified that where such exporters subsequently paid the exempted tax and cess along with interest and had the bill of entry reassessed by the customs authorities, the exemption is treated as not having been availed and the refund already taken stands regularised.
Practical effect: Chennai exporters facing recovery of integrated tax refunds under Rule 96(10) can close the issue by paying the import duties with interest and getting the bill of entry reassessed.

Under the new Schedule I, woven fabrics of silk, wool, cotton, other vegetable fibres, man-made filaments and man-made staple fibres, knitted and crocheted fabrics, sewing thread of man-made filaments and staple fibres, and worn clothing and rags all attract five per cent. Man-made fibre and yarn, which had long been taxed higher than the cloth made from them, were also brought down, largely correcting the inverted duty structure that had troubled the Tamil Nadu textile belt since 2017.

The 56th GST Council meeting approved the biggest structural reform since 2017, replacing the 5, 12, 18 and 28 per cent slabs with a two-rate structure — a 5 per cent merit rate and an 18 per cent standard rate — plus a 40 per cent de-merit rate for a narrow set of luxury and sin goods.
