32nd GST Council Meeting, New Delhi — 10 January 2019 · 2019-01-10
The Council created two threshold limits for exemption from registration and payment of GST for suppliers of goods, Rs 40 lakh and Rs 20 lakh, and gave states a week to choose which limit would apply in their territory. The threshold for service providers was left unchanged at Rs 20 lakh, and at Rs 10 lakh for special category states. The change was made operational from 1 April 2019 and remains the basic registration test for traders and manufacturers today.
What it means for you: A Chennai trader dealing only in goods crosses the registration line at Rs 40 lakh of aggregate turnover, but a service provider must register at Rs 20 lakh.
Shyam Sel and Power Ltd v. State of U.P. — Allahabad High Court, Writ Tax No. 603 of 2023, judgment dated 5 October 2023 · 2023-10-05
Goods moved under a valid e-way bill which the purchaser cancelled without informing the seller. The goods were seized and penalty imposed under Section 129(3). Relying on the Supreme Court's decision in Satyam Shivam Papers, the High Court quashed the penalty and the appellate order, holding that intent to evade tax is mandatory for invoking Sections 129 and 130. Where the breach is minor and unintentional, the department should have proceeded, if at all, under Section 122.
What to do about it: A cancellation or defect caused by your customer, of which you had no notice, is a strong defence against a Section 129 penalty.
Circular No. 141/11/2020-GST dated 24 June 2020 · 2020-06-24
This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.
What to do about it: The late fee waiver here is conditional: if the GSTR-3B was not filed by the notified date, late fee runs from the original due date, so the actual filing date decides whether any waiver survives.
