Notification No. 44/2019-Central Tax dated 09.10.2019 · 2019-10-09

This notification prescribed that the return in FORM GSTR-3B for each of the months from October 2019 to March 2020 was to be furnished electronically on or before the twentieth day of the month succeeding the month concerned, and that the tax due had to be discharged by debiting the electronic cash or credit ledger not later than the same date. It continued the practice of notifying GSTR-3B due dates in six month blocks.

What it means for you: The twentieth of the following month remains the familiar GSTR-3B deadline for larger Chennai taxpayers, and payment must accompany the return, not follow it.

Aryan Timber Store v. Sales Tax Officer, Class II/AVATO, Ward 62 — Delhi High Court, judgment dated 18 January 2024 · 2024-01-18

The registration was cancelled with retrospective effect from a date long before the show cause notice, and the notice itself never proposed retrospective cancellation. The High Court held that retrospective cancellation cannot be mechanical; the officer must have objective material, must put the taxpayer on notice of the intention to cancel from a back date, and must consider the consequence that customers lose their input tax credit. The cancellation was confined to the date from which the taxpayer had sought cancellation.

What it means for you: If your registration was cancelled from a back date, check whether the show cause notice ever mentioned retrospective effect — that omission alone has repeatedly got such orders modified.

A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

What it means for you: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. I applied for GST registration in Chennai and received a REG-03 notice. What does it mean?
Form REG-03 is a notice seeking clarification on your GST registration application. The officer may question your proof of principal place of business, promoter identity documents or the nature of business declared. You must reply in Form REG-04 within seven working days of the notice, uploading the clarification and supporting documents on the GST portal. If no reply is filed, the officer can reject the application in Form REG-05. Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
The GST department has issued me a summons under Section 70. Is it serious?
Yes, a summons should never be ignored. Under Section 70 the officer has the powers of a civil court, and the inquiry is a judicial proceeding. You must appear on the given date and time with the documents listed, and your statement will be recorded. Non-appearance can invite penalty and, in extreme cases, prosecution. Before attending, reconstruct the facts, reconcile your returns and carry organised records of the transactions under inquiry. The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
How much time does the GST department have to issue a demand under Section 73?
For a Section 73 demand, the adjudication order must be passed within three years from the due date of the annual return for the financial year concerned, and the show cause notice must be issued at least three months before that deadline. For Section 74 fraud cases, the order deadline is five years with the notice issued at least six months earlier. For tax periods from FY 2024-25 onwards, a new common provision in Section 74A applies with its own timelines. Always check limitation first; notices issued beyond these dates can be challenged as time-barred, which ChennaiGST examines in every Chennai demand case.
How will I be informed of the GST audit findings?
On conclusion of the audit, the officer must inform you of the findings, your rights and obligations, and the reasons for the findings in Form ADT-02 within thirty days. Before that, most audit teams share draft observations and seek your response, which is your best window to knock out weak points with documents. If the audit detects unpaid tax or wrongly availed ITC, you can accept and pay through DRC-03, or contest, in which case the department initiates proceedings under Section 73 or Section 74. How many days do I get to reply to an ASMT-10 notice?
The reply in Form ASMT-11 must be filed within thirty days of being informed of the discrepancies, or within such further time as the officer permits. If you need more time to gather reconciliations, write to the officer seeking an extension before the deadline instead of staying silent. The thirty days pass quickly because a proper reply needs invoice-level matching of GSTR-1, GSTR-3B, GSTR-2B and your books, so start compiling data the day the notice arrives. Can one invoice contain items taxed at different GST rates?
Yes, there is no requirement to issue separate invoices per rate. I have taken a house on rent and I am GST registered. Does reverse charge hit my house rent?
Only in defined situations. From 18 July 2022, renting of a residential dwelling to a registered person attracts 18 percent under reverse charge in the tenant's hands. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
