States were given a short period to convey their choice.

From 22 September 2025 articles of apparel and clothing accessories of Chapters 61 and 62, other made-up textile articles of Chapter 63 and footwear of Chapter 64 attract five per cent where the sale value does not exceed Rs 2,500 per piece or per pair, and eighteen per cent where it exceeds that figure. The old thresholds of Rs 1,000 for garments and the flat twelve per cent on all footwear are gone, and the test is sale value, not maximum retail price.

A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

How we apply it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

What are the current GST rate slabs after the GST 2.0 changes?
From 22 September 2025, following the 56th GST Council meeting, India moved to a simplified two-slab structure: a merit rate of 5 percent and a standard rate of 18 percent. The earlier 12 percent and 28 percent slabs were abolished. A special 40 percent rate applies to a short list of luxury and demerit goods, while the concessional rates of 3 percent on gold and silver and 0.25 percent on rough diamonds continue. Businesses in Vandalur should re-verify the rate on every product they sell, because hundreds of items changed slabs on that date.

Two rules operate. For admission to an event, including tickets to exhibitions or conferences, the place of supply is where the event is held. Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. When a jeweller bills a customer, the metal value and making charges can appear as separate line items with their respective rates on the same tax invoice. Old gold purchased from an unregistered customer in exchange transactions does not attract GST in the customer's hands, but valuation of the net supply must be documented carefully.
Is GST charged before or after the discount shown on my invoice?
Discounts given before or at the time of supply and recorded on the face of the invoice are excluded from the value of supply under Section 15(3)(a). You therefore charge GST on the net amount after discount. For example, a Rs.10,000 item with a 10 percent trade discount shown on the invoice is taxed on Rs.9,000. The condition is documentation: the discount must appear on the invoice itself. Informal reductions settled outside the bill do not reduce taxable value. Retail schemes such as festival discounts and trade margins should always be structured to print on the invoice.
How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation. A taxable person who is liable to register but fails to do so faces a penalty of Rs.10,000 or the amount of tax evaded, whichever is higher, under Section 122 of the CGST Act. Beyond the penalty, the department can demand the tax for the entire unregistered period with interest at 18 percent per annum, and you cannot recover that tax from customers you billed without GST. Goods moved without registration and e-way bills, required for consignments above Rs.50,000, also risk detention.
