Notification No. 44/2019-Central Tax dated 09.10.2019 · 2019-10-09

This notification prescribed that the return in FORM GSTR-3B for each of the months from October 2019 to March 2020 was to be furnished electronically on or before the twentieth day of the month succeeding the month concerned, and that the tax due had to be discharged by debiting the electronic cash or credit ledger not later than the same date. It continued the practice of notifying GSTR-3B due dates in six month blocks.

The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. What is the general penalty under Section 125 and when is it imposed?
Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else. It can extend to Rs.25,000 under the CGST Act, with a matching penalty under the SGST Act, so the practical exposure is up to Rs.50,000 per contravention. Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. Because the amount is discretionary, a reasoned reply showing the breach was technical and without revenue loss often brings the figure down substantially.
The GST department has issued me a summons under Section 70. Is it serious?
Yes, a summons should never be ignored. Under Section 70 the officer has the powers of a civil court, and the inquiry is a judicial proceeding. You must appear on the given date and time with the documents listed, and your statement will be recorded. Non-appearance can invite penalty and, in extreme cases, prosecution. Before attending, reconstruct the facts, reconcile your returns and carry organised records of the transactions under inquiry. What is a GST health check and does my business really need one?
A GST health check is a preventive review of your compliance before the department finds the gaps. It typically covers reconciliation of GSTR-1 with GSTR-3B and books, ITC matching against GSTR-2B, blocked credit review under Section 17(5), reverse charge exposure, e-invoice and e-way bill compliance, rate and classification checks, and pending return or payment issues. I deposited money under the wrong head in my GST cash ledger. Why can the amount not be used?
The cash ledger is divided into major heads, IGST, CGST, SGST and cess, and minor heads, tax, interest, penalty, fee and others. What are OIDAR services under GST and who pays the tax on them?
OIDAR means Online Information Database Access or Retrieval services, delivered over the internet, such as cloud services, e-books, streaming, online advertising and automated e-learning. When a foreign OIDAR provider supplies these to unregistered persons in India, the foreign provider itself must take a simplified registration in Form REG-10 and file monthly return GSTR-5A. From 1 October 2023, the definition was widened, so almost every unregistered Indian recipient is covered. When the Indian recipient is GST-registered, the tax instead falls on the recipient under reverse charge as an import of services.
Do I have to issue an invoice for every small cash sale in my shop?
Not necessarily. Where the value of a supply is less than Rs.200, the buyer is unregistered, and the buyer does not ask for an invoice, you may skip issuing an individual tax invoice. Instead, you must prepare one consolidated tax invoice at the close of each day covering all such small sales. The moment a customer demands an invoice, or the sale is Rs.200 or more, a proper invoice is required. Retail counters typically issue system receipts to every customer anyway, which is cleaner practice, but the daily consolidated invoice is the legal minimum for petty sales.
Can you give me a simple GST due-date calendar for my business?
For monthly filers: GSTR-1 by the 11th and GSTR-3B by the 20th of the next month. Under QRMP: optional IFF by the 13th of the next month, PMT-06 payment by the 25th, quarterly GSTR-1 by the 13th and GSTR-3B by the 22nd (Tamil Nadu) after the quarter.
