Rate and exemption clarifications on services after the 47th Council

Circular No. 177/09/2022-TRU · 2022-08-03

The Board answered a set of service classification and exemption questions arising from the 47th GST Council meeting. Most importantly for property transactions, it confirmed that the sale of land after levelling and after laying drainage, water and electricity lines remains a sale of land under Schedule III and is outside GST, while development services such as levelling and laying of drainage lines that the developer itself receives from contractors attract GST at the applicable rate. Several other exemption and rate questions on specified services were also settled.

To revive the residential real estate sector, the Council recommended an effective GST rate of five per cent without input tax credit on residential properties outside the affordable segment, and one per cent without input tax credit on affordable housing, with effect from 1 April 2019. The Council reasoned that buyers would get a fair price, that disputes about builders not passing on credit would become irrelevant, and that unutilised credit which used to become a project cost would be removed.

Practical effect: Flat buyers in Chennai pay one or five per cent on under-construction purchases, but the builder cannot claim input credit, so the tax is embedded in the price rather than shown as recoverable.

My CMP-08 shows a negative liability adjustment I never claimed. What is the negative liability statement?
Composition taxpayers have a separate negative liability statement on the portal. It typically gets populated when the annual GSTR-4 is filed with Table 6 left blank; the system then treats the tax already paid through the year's CMP-08 statements as excess, creating a negative balance that silently adjusts future CMP-08 liabilities. If the negative entry is genuine excess payment, it can remain as adjustment; if it arose from a blank Table 6, the department expects you to deposit the wrongly adjusted amount through DRC-03 and report Table 6 correctly. How do I switch my regular GST registration to the composition scheme?
An existing regular taxpayer opts in by filing Form CMP-02 on the GST portal before the beginning of the financial year for which the scheme is sought, and the option takes effect from 1 April. Is an ice cream parlour or sweet shop taxed like a restaurant at 5%?
Not automatically. CBIC Circular 164/20/2021 clarified that ice cream parlours selling already manufactured ice cream are supplying goods, not restaurant service, so the rate of the goods applies; ice cream itself moved to 5% in the September 2025 rate rationalisation. Sweets sold over the counter are likewise goods, with sweetmeats attracting 5%. However, where a sweet shop also runs a seating area serving prepared food, that portion can qualify as restaurant service at 5% without input credit. We sponsored a trade event. Does reverse charge apply to the sponsorship amount?
If your business is a body corporate or partnership firm, sponsorship services received are notified under Section 9(3) and you must pay 18 percent GST under reverse charge, with ITC available since sponsorship is a marketing expense. One recent change matters: with effect from 16 January 2025, sponsorship services provided by a body corporate were moved to forward charge, so if the event organiser billing you is a company, it now charges GST on its invoice and RCM does not apply. Where the provider is a proprietor, trust or society, RCM continues. Verify the organiser's constitution before booking the entry, and raise a self-invoice where the provider is unregistered.
Is a pure labour contract for building a house exempt from GST?
Two exemptions exist for pure labour contracts, meaning contracts where the contractor supplies only labour and the owner buys all materials. First, construction, erection or installation of original works pertaining to a single residential unit, otherwise than as part of a residential complex, is exempt. Second, pure labour services under the Pradhan Mantri Awas Yojana for beneficiary-led individual house construction are exempt. Outside these, labour contracts are taxable at 18 percent. A mason team building one independent house in Chennai on labour-only terms therefore charges no GST, but the same team working on an apartment project must.
What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy.
