The Council decided that the rate changes needed to correct the inverted duty structure in the footwear and textiles sectors, discussed and deferred at an earlier meeting, would be implemented with effect from 1 January 2022. The correction involved moving fabrics, garments and footwear below the earlier value thresholds from 5 per cent up to 12 per cent so that output tax would exceed input tax and refund claims would cease. The Council also set up Groups of Ministers on rate rationalisation and on using technology to improve compliance.

A printing house printed leaflets and similar material using content supplied by the customer but paper, ink and other physical inputs of its own. It asked for the correct classification and rate. The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.

A five-judge Bench held that an exemption notification must be interpreted strictly, and the burden of proving entitlement lies on the person claiming it. If there is genuine ambiguity in the wording of an exemption, the benefit of doubt goes to the revenue, not the taxpayer. This overruled the contrary view in Sun Export. The principle applies squarely to GST exemption and concessional rate notifications.
What to do about it: A Chennai business claiming a GST exemption or concessional rate must fit precisely within the notification's wording, as courts will not read it liberally.
