Saro Enterprises - AAR Tamil Nadu (2018), upheld by AAAR Tamil Nadu, order dated 6 February 2019 · 2018

The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

What it means for you: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.

No claim bonus in insurance and entity-wise exemption from e-invoicing

Circular No. 186/18/2022-GST · 2022-12-27

The Board clarified two unrelated points. A no claim bonus allowed by an insurer is a permissible discount under Section 15(3)(a) and may be deducted from the value of the insurance service, provided it is shown in the invoice. Separately, where an entity is exempt from the requirement to issue e-invoices, that exemption attaches to the entity as a whole and covers all its supplies, including supplies unrelated to the activity that gave rise to the exemption.

Residential rent exemption withdrawn where the tenant is registered

Notification No. 04/2022-Central Tax (Rate) dated 13.07.2022 · 2022-07-13

This notification amended the services exemption list to give effect to the 47th Council's decisions. Entry 12, which exempted renting of a residential dwelling for use as residence, was made subject to the condition that the recipient is not a registered person. The notification also withdrew the exemption for hotel accommodation priced up to one thousand rupees per unit per day and the value-based exemptions for small freight consignments carried by goods transport agencies. The changes took effect from 18 July 2022.

Practical effect: A Chennai landlord letting a flat to a GST-registered firm no longer supplies an exempt service, and the tenant must account for the tax under reverse charge.

Is there really a penalty for not displaying my GST number at my shop?
Yes. Rule 18 of the CGST Rules requires every registered person to display the registration certificate in a prominent location at the principal place of business and every additional place, and to display the GSTIN on the name board at the entry of each such premises. There is no separate penalty provision for this lapse, so officers invoke the general penalty under Section 125, which can extend to Rs.25,000 under CGST with a matching state penalty. Which everyday goods now attract 5 percent GST?
The 5 percent slab now covers most household essentials that earlier fell in the 12 or 18 percent brackets: soaps, shampoos, toothpaste and toothbrushes, hair oil, bicycles, kitchen utensils and tableware. Packaged foods such as butter, ghee, cheese, namkeens, sauces, pasta, biscuits and chocolates are also at 5 percent, as are most medicines, medical devices and agricultural machinery. Apparel and footwear priced up to Rs.2,500 per piece attract 5 percent as well. Rule 55 permits movement on a delivery challan where the transportation is not itself a supply: sending inputs or capital goods for job work, taking goods to an exhibition or for approval where the sale is not yet certain, supplying liquid gas where the quantity is unknown at removal, and moving goods in semi-knocked-down form in multiple consignments, where the full invoice travels with the first lot. The challan is prepared in triplicate and an e-way bill is still required where value thresholds are crossed. Goods sent on approval must be invoiced within six months, failing which tax becomes payable.
