GSTN Advisory, 2022 — Table 3.1.1 of Form GSTR-3B introduced by Notification No. 14/2022-Central Tax, dated 5 July 2022 · 2022

Table 3.1.1 was added to GSTR-3B so that supplies notified under Section 9(5), such as passenger transport, restaurant service supplied through an app, hotel accommodation and housekeeping, are reported separately. The e-commerce operator reports the value and pays the tax in row (i), while the underlying supplier reports the same value in row (ii) and pays nothing on it, so the turnover is not counted twice across the two returns.

Practical effect: Chennai restaurants and cab operators supplying through an app must still report those sales in Table 3.1.1(ii) even though the platform pays the tax.

Nithiyashree Ladies Hostel - AAR Tamil Nadu, Advance Ruling No. 77/AAR/2023, dated 4 September 2023 · 2023-09-04

The applicant ran a ladies hostel in premises it had itself taken on rent and supplied accommodation together with food and related services. It sought exemption on the footing that this was renting of residential accommodation. The Authority held the supply classifiable under heading 9963 and taxable at 9 percent central tax and 9 percent State tax, treating hostel accommodation with attached services as a taxable service and not as renting of a residential dwelling for use as a residence.

Rule 88B inserted and GSTR-3B credit reporting overhauled

Notification No. 14/2022-Central Tax · 2022-07-05

The Central Goods and Services Tax (Amendment) Rules, 2022 inserted Rule 88B, which prescribes the manner of computing interest on delayed payment of tax and on wrongly availed and utilised credit, giving statutory form to the net cash liability principle. The notification also revised Table 4 of Form GSTR-3B so that gross credit, permanent reversals and temporary reversals are reported separately, and permitted payment of tax through unified payments interface and immediate payment service.

What to do about it: From the July 2022 return onwards, a Chennai business must report reversals correctly in the revised Table 4, since the department reconciles that table directly against GSTR-2B.

Report the taxable value and tax in Table 3.1(d) of GSTR-3B; this liability must be discharged in cash through the electronic cash ledger, because input tax credit cannot be used to pay reverse charge dues. In the same return, claim the amount as ITC in Table 4(A)(2) or 4(A)(3), so the net impact is usually nil. RCM invoices from registered suppliers like GTAs appear in GSTR-2B, but credit for unregistered-supplier RCM rests on your self-invoice, and Circular 211/5/2024 confirms the Section 16(4) deadline runs from the year of that self-invoice. How are B2B and B2C invoices reported differently in GST returns?
B2B invoices, meaning supplies to registered buyers, are reported invoice by invoice in Table 4 of GSTR-1 with the buyer's GSTIN, so each one flows into that buyer's GSTR-2B for credit. B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. This is why capturing the buyer's GSTIN correctly at billing matters so much; an invoice keyed as B2C by a cashier gives the registered buyer no credit and triggers correction requests later.
Can I issue a single credit note against several invoices?
Yes. Since the amendment to Section 34 by the CGST (Amendment) Act, 2018, effective 1 February 2019, the law permits one or more credit notes to be issued against one or more tax invoices of a financial year. A distributor giving a season-end adjustment to a retailer can therefore issue one consolidated credit note covering dozens of invoices, rather than one note per bill. When reporting it in GSTR-1, the portal accepts credit notes without invoice-wise linking for this reason. Maintain a working annexed to the credit note listing the invoices covered, because in scrutiny the officer will ask you to establish the linkage and the arithmetic.
How does a GTA opt for forward charge, and by when must it be done?
The option is exercised by filing the Annexure V declaration on the GST portal. For an existing GTA, the window for a financial year runs from 1 January to 31 March of the preceding financial year, so the choice for the coming year must be locked in by 31 March. A newly registered GTA must file the declaration within forty-five days of applying for registration or one month from the date of obtaining registration, whichever is later. Once exercised, the option continues for future years automatically unless the GTA files Annexure VI to revert to reverse charge. Missing the window means remaining under the default reverse charge mechanism for the whole year.
Why is the portal not letting me file GSTR-1?
Under Rule 59(6) of the CGST Rules, the portal blocks GSTR-1 filing if the GSTR-3B of the preceding tax period has not been filed. GST returns are sequential, so a single skipped GSTR-3B stops the entire chain. The fix is to file the pending GSTR-3B along with its late fee and interest, after which GSTR-1 opens up again. My supplier is delivering one order in several instalments. When can I claim the ITC?
Where goods against a single invoice are received in lots or instalments, the first proviso to Section 16(2) permits the credit only upon receipt of the last lot. So if machinery invoiced in March arrives in four consignments ending in May, the entire ITC is claimable only in May, even though the invoice is dated March. Claiming it earlier is a premature availment that can be flagged in scrutiny. Track part deliveries against invoices in your inward register, and defer the credit in your reconciliation working until the final consignment is booked. This timing point is routinely missed by businesses in Chennai handling bulk orders.
My business had zero sales this month. Do I still need to file GST returns?
Yes. Every registered taxpayer must file returns for every tax period, even when there are no sales, no purchases and no tax liability. In that case you file nil GSTR-1 and nil GSTR-3B. Failure to file nil returns attracts a late fee of Rs.20 per day per return, capped at Rs.500 per return, and breaks the sequential filing chain. Yes, through Rule 37A. What is the difference between the electronic cash ledger and the electronic credit ledger?
The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. Both are visible under Services, then Ledgers, after login. Refund of an excess cash balance is possible, while credit is refundable only in specified cases such as exports and inverted duty structure.
How does GST work on lorry freight paid to a goods transport agency?
A goods transport agency, identified by its issue of a consignment note, is taxed in one of two ways. By default, specified recipients such as companies and registered persons pay 5 percent under reverse charge on the freight and can claim it as ITC. Alternatively, the GTA may opt to pay tax itself under forward charge, at 5 percent without ITC or 18 percent with ITC after the September 2025 rate rationalisation replaced the earlier 12 percent option, by filing the prescribed declaration for the financial year; the invoice should state this option. Transport by an individual lorry owner without a consignment note is not a GTA service and is exempt. Check each transporter's invoice wording before deciding who pays the tax.
How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Consultants and agencies that bill quarterly should check their contracts against these rules, since late invoicing defers nothing legally.
What is the penalty for running a business without GST registration?
A taxable person who is liable to register but fails to do so faces a penalty of Rs.10,000 or the amount of tax evaded, whichever is higher, under Section 122 of the CGST Act. Beyond the penalty, the department can demand the tax for the entire unregistered period with interest at 18 percent per annum, and you cannot recover that tax from customers you billed without GST. Goods moved without registration and e-way bills, required for consignments above Rs.50,000, also risk detention. If your turnover has crossed the threshold, registering within thirty days is far cheaper than regularising later.
