The Council recommended reducing the GST rate from 28 to 18 per cent on goods falling in 178 headings at the four-digit level, including four headings only partially pruned, so that the 28 per cent list fell from 224 tariff headings to only about 50. Further reductions were recommended from 28 to 12 per cent, from 18 to 12 per cent and from 18 to 5 per cent on specified goods, together with relief for the aviation and handicraft sectors and restaurants.

A batch of writ petitions challenged reversal of input tax credit on the footing that the suppliers had not actually supplied any goods. The Madras High Court dismissed all the petitions, holding that the burden of proving that an ITC claim is correct lies on the purchasing dealer, and that invoices alone, unsupported by e-way bills and other evidence of physical movement of goods, are not sufficient to sustain the credit.

Circular No. 124/43/2019-GST dated 18 November 2019 · 2019-11-18
Notification No. 47/2019-Central Tax made the annual return optional for registered persons with aggregate turnover below Rs 2 crore for the financial years 2017-18 and 2018-19. CBIC clarified that such a taxpayer who does not file FORM GSTR-9 by the due date will be deemed to have furnished it, and that a return filed after the due date will not be treated as deemed furnished. Taxpayers were nevertheless encouraged to file, since the return remains the vehicle for correcting reported figures.
