A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

Practical effect: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Electric vehicles without batteries and other rate clarifications

Circular No. 179/11/2022-GST, dated 3 August 2022 · 2022-08-03

Implementing the 47th GST Council recommendations, CBIC clarified that an electrically operated vehicle attracts the concessional five per cent rate whether or not it is fitted with a battery pack at the time of supply, ending a dispute that had hurt manufacturers using battery-swapping models. The circular also addressed the classification of fly ash bricks and blocks, by-products of milling of pulses and dal such as chilka and khanda, treated sewage water, and nicotine polacrilex gum.

What it means for you: Electric vehicle sellers should not be forced into eighteen per cent merely because the battery is billed or leased separately, and this circular is the answer to such a notice.

The Supreme Court held that a tax is not per se a restriction on the freedom of trade and commerce guaranteed by Article 301 of the Constitution. Only a discriminatory tax that favours local goods over goods from other States is hit. The judicially created concept of compensatory tax was discarded as having no constitutional basis. State entry tax laws were largely upheld, subject to the test of discrimination.

What to do about it: Chennai businesses challenging a State levy must show actual discrimination against outside goods, not merely that the levy burdens interstate trade.

What are OIDAR services under GST and who pays the tax on them?
OIDAR means Online Information Database Access or Retrieval services, delivered over the internet, such as cloud services, e-books, streaming, online advertising and automated e-learning. When a foreign OIDAR provider supplies these to unregistered persons in India, the foreign provider itself must take a simplified registration in Form REG-10 and file monthly return GSTR-5A. From 1 October 2023, the definition was widened, so almost every unregistered Indian recipient is covered. When the Indian recipient is GST-registered, the tax instead falls on the recipient under reverse charge as an import of services.
Is GST payable under reverse charge on payments made to our company directors?
It depends on the capacity in which the director is paid. CBIC Circular 140/10/2020 settles the position: remuneration to a whole-time or executive director who is an employee, paid as salary with TDS under Section 192, is outside GST entirely as an employer-employee transaction. In contrast, sitting fees, commission and professional charges paid to independent or non-executive directors, typically suffering TDS under Section 194J, are taxable and the company pays 18 percent under reverse charge, claiming ITC. Companies in Ayanambakkam should split their director payments ledger accordingly, issue self-invoices for the RCM portion, and keep board resolutions and TDS treatment consistent as supporting evidence.
What is the difference between the electronic cash ledger and the electronic credit ledger?

If I open a bulk bag and sell rice loose by weight, is that sale taxable?
No. The 5% levy on specified food items applies only when they are supplied in pre-packaged and labelled form in packs up to 25 kilograms. When a retailer opens bulk stock and weighs out loose quantities against each customer's order, the supply is not of a pre-packaged commodity, so it remains exempt. What you cannot do is sell an intact labelled retail pack and bill it as loose. Keep purchase records showing bulk procurement and maintain the loose counter separately from the packed shelf, because officers test this distinction during inspections of grocery businesses. Is GST still charged on health insurance premiums?
Not on individual policies. With effect from 22 September 2025, premiums on all individual life insurance policies and individual health insurance policies, including family floater and senior citizen plans, are exempt from GST, along with their reinsurance. Earlier these attracted 18 percent, so the change directly reduces the premium outgo for households. Group policies taken by businesses for employees continue to be taxable, and the input tax credit position on such group covers still depends on whether the cover is statutorily obligatory. When renewing policies, check that the insurer has passed on the exemption rather than merely repricing the premium.
What is the electronic liability register on the GST portal and why should I check it?
The electronic liability register, maintained in Form PMT-01, records every liability raised against your GSTIN: self-assessed tax from returns in Part I, and demands from assessments, adjudication orders and DRC-07 summaries in Part II. Payments and pre-deposits are set off against these entries. You can view it under Services, then Ledgers. Checking Part II periodically matters because demand entries you never noticed can trigger recovery, interest accumulation and refund adjustments. My GST status shows suspended. What does that mean for my business in Ayanambakkam?

With ISD distribution mandatory for common third-party input services from 1 April 2025, businesses must now run both mechanisms side by side, each for its correct category.
Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in Ayanambakkam buying stationery from an unregistered shop has no Section 9(4) liability at all.
How does GST work on lorry freight paid to a goods transport agency?
A goods transport agency, identified by its issue of a consignment note, is taxed in one of two ways. By default, specified recipients such as companies and registered persons pay 5 percent under reverse charge on the freight and can claim it as ITC. Alternatively, the GTA may opt to pay tax itself under forward charge, at 5 percent without ITC or 18 percent with ITC after the September 2025 rate rationalisation replaced the earlier 12 percent option, by filing the prescribed declaration for the financial year; the invoice should state this option. What documents must I prepare for reverse charge purchases from unregistered suppliers?
Two documents are required. First, a self-invoice: Section 31(3)(f) obliges you to issue an invoice on yourself for goods or services received from an unregistered supplier on which you pay tax under reverse charge, and under Rule 47A this self-invoice must be issued within thirty days of receiving the supply. Second, a payment voucher under Rule 52 at the time of making payment to the supplier. The self-invoice is the document on which you claim the input tax credit of the reverse charge tax paid. Freight from unregistered transporters and advocate fees are typical cases where businesses miss this paperwork.
How do I decide whether to charge CGST plus SGST or IGST on an invoice?
Compare two data points: the location of the supplier and the place of supply determined under the IGST Act. If both fall in the same state, the supply is intra-state and you charge CGST plus SGST; if they fall in different states, it is inter-state and you charge IGST. The buyer's billing address alone is not the test; the place of supply rules for the specific goods or service govern.
