GST for IT and SaaS Companies in Peravallur
IT and SaaS services are taxed at 18 percent domestically, but the real complexity is qualifying overseas billing as export under Section 2(6) of the IGST Act: the recipient must be outside India, consideration must arrive in convertible foreign exchange or INR where RBI permits, and the Indian entity and foreign recipient must not be mere establishments of the same person. Marketing or support arms serving a foreign parent risk classification as intermediaries under Section 13(8), making the place of supply India and the income taxable. Supplies to SEZ units are zero-rated with proper endorsements. A specialist structures contracts and invoicing so export status survives departmental scrutiny.

Why Us

Why Peravallur Businesses Choose ChennaiGST

Local jurisdiction knowledge plus senior-level review on every filing.

E-Invoice and E-Way Bill Fluency

E-invoicing is mandatory once turnover crosses Rs.5 crore and e-way bills apply to goods movements above Rs.50,000. We set up, train and troubleshoot both systems, so your despatches from Peravallur are never held up by a compliance gap at the gate.

ITC Maximisation Within the Law

We match your purchase register against GSTR-2B every period, follow up on invoices your suppliers have not uploaded, and ensure every rupee of eligible input tax credit is claimed. Clients routinely recover credit they were silently losing under self-filing.

Composition Scheme Compliance Without Slips

Composition dealers have their own rulebook — CMP-08 every quarter, GSTR-4 annually by 30 June, bills of supply instead of tax invoices, and a turnover ceiling that must be watched. We handle each of these correctly so the scheme's simplicity never turns into a violation.

Cancelled GSTIN? We Handle Revocation Too

A registration cancelled for non-filing is not the end of the road. We bring the pending returns up to date, clear the dues and file the revocation application in REG-21 within the permitted window, restoring suspended and cancelled GSTINs to active status.

Proactive Alerts Before Problems Become Notices

If your GSTR-1 and GSTR-3B start drifting apart, if a large supplier stops filing, or if your turnover approaches the e-invoice threshold, we flag it to you immediately. Early warnings from our side are cheaper than departmental letters later.

We Work with Your Existing Software

Tally, Zoho Books, Busy, marketplace reports, plain Excel or even a handwritten bill book — we take your data in whatever form your Peravallur business already maintains it. You are never forced to buy new software or retrain staff just to become our client.

Case Law

Supreme Court lays down the aspect doctrine for splitting composite transactions

Bharat Sanchar Nigam Ltd v. Union of India — Supreme Court, (2006) 3 SCC 1, judgment dated 02-03-2006 · 2006-03-02

The Supreme Court held that the same transaction may have a goods aspect and a service aspect, and different legislatures may tax different aspects, but the same element cannot be taxed twice. A composite contract cannot be split into goods and services except in the cases specifically permitted by Article 366(29A), such as works contracts and catering. The dominant nature test was applied to decide the character of the contract.

Practical effect: Chennai businesses with bundled offerings should determine the dominant character of the supply, since that decides classification and rate under GST.

Circular

Mid-day meal and anganwadi catering treated as exempt

Circular No. 149/05/2021-GST dated 17.06.2021 · 2021-06-17

CBIC clarified that serving food in schools under the mid-day meal programme is exempt from GST, and that the exemption extends to pre-schools and anganwadis, which are covered within the meaning of an educational institution providing pre-school education. It further clarified that the exemption applies whether the meals are funded by government grants or by corporate donations, since the entry does not distinguish by source of funding. The clarification protected non-profit caterers running school feeding programmes from demands.

Why this matters: Chennai caterers running school or anganwadi meal contracts are exempt, but should keep the scheme documentation on file to answer any scrutiny.

GST Council

Single-agenda meeting on GST compensation offers states two borrowing options

41st GST Council Meeting (video conferencing) — 27 August 2020 · 2020-08-27

The 41st meeting was convened with a single agenda item, GST compensation to states and union territories, after collections collapsed during the pandemic. The Centre placed before the Council two borrowing options for meeting the compensation shortfall for 2020-21: a special window facilitated by the Reserve Bank of India for the portion of the shortfall attributed to GST implementation itself, or market borrowing of the entire estimated shortfall by the states, in both cases serviced from future compensation cess collections. States were given a short period to convey their choice.

Practical effect: The borrowings arranged here are why compensation cess continued to be collected on cess goods long after the five-year compensation period ended in June 2022.

FAQs

Frequently Asked Questions

Straight answers from practising GST consultants — based on the CGST Act, current CBIC notifications and day-to-day portal experience.

How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation. Getting this right decides whether you charge CGST plus SGST or IGST, and a Peravallur seller delivering to a Bengaluru buyer charges IGST because delivery terminates in Karnataka.
How do I track the status of a grievance ticket or any ARN I have on the GST portal?
For grievance tickets, open selfservice.gstsystem.in and use Check Status by entering the ticket reference number; the screen shows whether it is open, under processing or resolved, with the resolution comments. For applications filed on the main portal, log in and use Services, then Track Application Status, choosing the module and entering the ARN, or open My Applications to see every application with its case detail folder, notices and replies in one place. Diarise every ARN the day it is generated, because reply windows run from portal timestamps. ChennaiGST maintains an ARN tracker for every client engagement.
What is the electronic liability register on the GST portal and why should I check it?
The electronic liability register, maintained in Form PMT-01, records every liability raised against your GSTIN: self-assessed tax from returns in Part I, and demands from assessments, adjudication orders and DRC-07 summaries in Part II. Payments and pre-deposits are set off against these entries. You can view it under Services, then Ledgers. Checking Part II periodically matters because demand entries you never noticed can trigger recovery, interest accumulation and refund adjustments. During any refund claim, the officer will offset outstanding register balances, so a clean register speeds up your money. We review all three ledgers in every Peravallur health check.
Which educational services are actually exempt from GST?
The exemption is confined to an educational institution as defined, meaning one providing pre-school education, education up to higher secondary school or equivalent, education as part of a curriculum for obtaining a qualification recognised by Indian law, or an approved vocational education course. Services by such institutions to their students, and specified input services to schools such as transport, catering and security, are exempt. Everything outside this boundary is taxable: private tuition, test preparation, hobby classes, skill courses without recognised certification, and training by ed-tech companies. The recognition of the qualification under Indian law is the decisive test, not the subject taught.
Is GST payable under reverse charge on payments made to our company directors?
It depends on the capacity in which the director is paid. CBIC Circular 140/10/2020 settles the position: remuneration to a whole-time or executive director who is an employee, paid as salary with TDS under Section 192, is outside GST entirely as an employer-employee transaction. In contrast, sitting fees, commission and professional charges paid to independent or non-executive directors, typically suffering TDS under Section 194J, are taxable and the company pays 18 percent under reverse charge, claiming ITC. Companies in Peravallur should split their director payments ledger accordingly, issue self-invoices for the RCM portion, and keep board resolutions and TDS treatment consistent as supporting evidence.
Can one document cover both taxable and exempt items sold together?
Yes, in one specific situation. Rule 46A permits a registered person supplying both taxable and exempt goods or services to an unregistered recipient to issue a single invoice-cum-bill of supply covering the entire transaction. This saves retail counters from splitting every mixed basket into two documents. The concession applies only when the buyer is unregistered; for a registered buyer, you must still issue a tax invoice for the taxable items and a separate bill of supply for the exempt items. Supermarkets and pharmacies with mixed inventories use this format daily, and billing software handles the split automatically once configured.
Which purchases commonly attract GST under reverse charge for a regular business?
Under Section 9(3), the recipient pays tax on notified supplies. The entries a typical business in Peravallur encounters are: goods transport agency services, services of advocates and arbitral tribunals, sponsorship provided to companies and partnership firms, services of directors, security services from non-corporate providers, renting of passenger motor vehicles from non-corporate operators charging five percent, import of services, and renting of property from unregistered landlords in notified cases. Each month, scan your expense ledger for these heads, pay the tax in cash through GSTR-3B, and claim it back as ITC where eligible. Missed RCM is among the top audit findings; call +91 - 9600 606 444 for an RCM exposure review.
What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. The Input Service Distributor mechanism distributes credit on third-party input services received at the head office but consumed by branches, such as an audit fee or software licence billed centrally; the ISD passes the credit itself through ISD invoices and GSTR-6, without charging tax again. Cross-charge applies where the head office performs a service for branches using its own resources; here the head office makes an outward supply, issues a tax invoice with tax, and the branch claims ITC. With ISD distribution mandatory for common third-party input services from 1 April 2025, businesses must now run both mechanisms side by side, each for its correct category.
What documents must I prepare for reverse charge purchases from unregistered suppliers?
Two documents are required. First, a self-invoice: Section 31(3)(f) obliges you to issue an invoice on yourself for goods or services received from an unregistered supplier on which you pay tax under reverse charge, and under Rule 47A this self-invoice must be issued within thirty days of receiving the supply. Second, a payment voucher under Rule 52 at the time of making payment to the supplier. The self-invoice is the document on which you claim the input tax credit of the reverse charge tax paid. Freight from unregistered transporters and advocate fees are typical cases where businesses miss this paperwork.
By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. In simple terms, the invoice must travel with the goods; a lorry leaving your Peravallur godown without an invoice is exposed to detention even if the e-way bill exists. For continuous supplies of goods with successive statements or payments, the invoice must be issued when each statement is issued or each payment is received.
Can my GST registration be cancelled for not filing returns?
Yes. Under Rule 21A, the department can suspend a GSTIN where returns are not filed for a continuous period, and Section 29 permits cancellation where a regular taxpayer has not filed returns for six months (two quarters for QRMP, and a composition taxpayer defaulting on the annual return beyond three months). During suspension you cannot issue tax invoices or file returns, which freezes the business. If cancellation happens, revocation must be sought through REG-21 within 90 days after clearing all dues. If you have received a suspension notice in Peravallur, call +91 - 9600 606 444 immediately.
How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Consultants and agencies that bill quarterly should check their contracts against these rules, since late invoicing defers nothing legally.
