It clarified that service by cloud kitchens and central kitchens is restaurant service attracting 5 per cent without input tax credit, while ice cream parlours that sell already manufactured ice cream without any element of cooking supply goods and attract the applicable goods rate with credit. It also clarified the treatment of coaching services supplied under a government scholarship scheme, overloading charges recovered at toll plazas, and services in relation to admission to amusement parks.

56th GST Council Meeting, New Delhi — 3 September 2025 · 2025-09-03
The 56th GST Council meeting approved the biggest structural reform since 2017, replacing the 5, 12, 18 and 28 per cent slabs with a two-rate structure — a 5 per cent merit rate and an 18 per cent standard rate — plus a 40 per cent de-merit rate for a narrow set of luxury and sin goods. Most items at 12 per cent moved to 5 per cent and most at 28 per cent moved to 18 per cent. The new rates took effect from 22 September 2025 and remain in force.

Abbott placed diagnostic instruments at hospitals and laboratories free of charge, on condition that the customer buy a minimum quantity of reagents and consumables over the contract period. The Kerala Authority for Advance Ruling, affirmed by the Appellate Authority, held that this was a composite supply on which tax was payable on the value of the instrument as well. The Kerala High Court set aside that view, holding that the placement of the instrument and the later sale of reagents are separate supplies and cannot be forced into one composite supply.
What to do about it: Where you place equipment with a customer against a minimum offtake commitment, keep the placement contract and the consumable sales documented as distinct transactions.
