CBIC clarified three recurring place-of-supply questions. For transportation of goods, including by mail or courier, where the supplier or the recipient is outside India, Section 13(9) of the IGST Act stood omitted from 1 October 2023, so the place of supply is now fixed by the default rule in Section 13(2), namely the location of the recipient. For advertising services supplied to a government body, the place of supply follows the location of the recipient under Section 12(2) rather than the location of the hoardings, with State-wise allocation where the contract provides for it. For co-location of servers in a data centre, the supply is a bundle of hosting services and not a letting of immovable property, so the recipient's location governs.

The Supreme Court held that where a developer enters into an agreement with a buyer before construction is completed, the construction carried out thereafter is executed for the buyer and constitutes a works contract liable to tax. Tax can be levied only on the value of goods incorporated after the agreement date, and the value of land must be excluded. This judgment underpins the current GST treatment of under-construction property sales.

Practical effect: Chennai builders must charge GST on units booked before completion, and must correctly exclude the land component from the taxable value.

Schedule III carries twenty per cent central tax, that is forty per cent combined, and is deliberately short. It covers aerated waters and other beverages containing added sugar or sweetening matter, caffeinated beverages, carbonated beverages of fruit drink, larger motor cars and hybrids above the small-car limits, motorcycles above 350 cc, aircraft for personal use, yachts and pleasure vessels, revolvers and pistols, smoking pipes and cigarette holders, and specified actionable claims such as betting, casinos, lottery and online money gaming.

Why this matters: Only a narrow list attracts forty per cent, so a supplier pushed into that slab by an officer should check whether the goods actually appear in Schedule III.

How do I round off tax amounts on a GST invoice?
Section 170 of the CGST Act prescribes normal rounding to the nearest rupee: where the tax contains a part of a rupee, fifty paise or more is rounded up to one rupee, and less than fifty paise is ignored. The rounding is applied to the tax amount on each invoice, separately for each tax head, so CGST and SGST are each rounded individually rather than rounding only the invoice total. Most billing software handles this automatically, but spreadsheets and manual bills often round the grand total instead, creating one-rupee mismatches that clutter reconciliations across thousands of invoices.
Where is the place of supply for services connected to a building or land?
Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). The recipient's location and registration are irrelevant. So a Choolaimedu architect designing a factory in Coimbatore charges CGST plus SGST of Tamil Nadu, but for a project in Kochi the place of supply is Kerala and IGST applies. How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Consultants and agencies that bill quarterly should check their contracts against these rules, since late invoicing defers nothing legally.
Who must sign GST filings with a DSC, and who can use EVC?
Companies and limited liability partnerships must authenticate registration applications and returns with a Digital Signature Certificate of the authorised signatory; the Electronic Verification Code route is not ordinarily available to them, though the government has periodically allowed EVC for companies during specified relaxation windows. Proprietorships, partnerships, HUFs and trusts can freely use EVC, an OTP sent to the authorised signatory's registered mobile and email. The DSC must be a Class 3 signature registered on the portal against the signatory's PAN. If a company's filings fail at the signing step, an expired or unregistered DSC is the usual culprit.
Is GST payable on hostel or paying guest accommodation in Choolaimedu?

By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. In simple terms, the invoice must travel with the goods; a lorry leaving your Choolaimedu godown without an invoice is exposed to detention even if the e-way bill exists. The GST rate on my product changed. Which rate applies to pending orders and invoices?
