The Council decided that the rate changes needed to correct the inverted duty structure in the footwear and textiles sectors, discussed and deferred at an earlier meeting, would be implemented with effect from 1 January 2022. The correction involved moving fabrics, garments and footwear below the earlier value thresholds from 5 per cent up to 12 per cent so that output tax would exceed input tax and refund claims would cease. The Council also set up Groups of Ministers on rate rationalisation and on using technology to improve compliance.

No second levy of IGST when goods leave a Free Trade Warehousing Zone

The Bank of Nova Scotia - AAR Tamil Nadu, Order No. TN/23/AAR/2018, dated 31 December 2018 · 2018-12-31

The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

Practical effect: Chennai importers using FTWZ facilities pay IGST once at clearance and should resist any demand for a second levy on removal.

A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

How we apply it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

How many digits of the HSN code must I print on my tax invoices?
Under Notification 78/2020 Central Tax, taxpayers with aggregate turnover up to Rs.5 crore in the preceding financial year must mention a 4-digit HSN code on all B2B tax invoices, though it is optional on B2C invoices. Taxpayers with turnover above Rs.5 crore must mention 6-digit HSN codes on every invoice, including B2C. Eight digits are required for specified goods such as certain chemicals and for export documentation. Services follow the same rule using SAC codes, which begin with 99. Printing truncated or wrong codes on invoices creates mismatches later, so set the codes correctly in your billing software once.
If I open a bulk bag and sell rice loose by weight, is that sale taxable?
No. The 5% levy on specified food items applies only when they are supplied in pre-packaged and labelled form in packs up to 25 kilograms. When a retailer opens bulk stock and weighs out loose quantities against each customer's order, the supply is not of a pre-packaged commodity, so it remains exempt. What you cannot do is sell an intact labelled retail pack and bill it as loose. Keep purchase records showing bulk procurement and maintain the loose counter separately from the packed shelf, because officers test this distinction during inspections of grocery businesses. What is self-invoicing under RCM and is there a time limit for it?
When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
Which goods and services attract the new 40 percent GST rate?
The 40 percent rate is confined to luxury and demerit supplies. It covers aerated waters, caffeinated and other sugary carbonated beverages, large cars beyond the small-car specifications, motorcycles above 350cc, yachts, personal aircraft, and specified actionable claims such as betting, casinos and online money gaming. Pan masala and tobacco products continue under their earlier levy structure until the compensation cess obligations are discharged, after which they move to the 40 percent rate as notified. If your business deals in any of these lines, pricing and working capital need careful planning.
The GST rate on my product changed. Which rate applies to pending orders and invoices?
Section 14 of the CGST Act decides this by looking at three events: the date of supply, the date of invoice and the date of payment. Broadly, if any two of the three events fall after the rate change, the new rate applies; if two fall before, the old rate applies. So goods delivered in Shenoy Nagar before 22 September 2025 but invoiced and paid for afterwards attract the new rate, while goods delivered and invoiced earlier keep the old rate even if payment came later.
