Notification No. 21/2021-Central Tax (Rate), dated 31 December 2021 · 2021-12-31

On 31 December 2021, the same day as the 46th GST Council meeting convened at the instance of Tamil Nadu and other States, the Government superseded the November notification. The proposed increase on textiles was dropped, so fabrics, yarn, garments and made-ups continued at five per cent, but the footwear change survived and all footwear became taxable at twelve per cent from 1 January 2022 irrespective of price. The value threshold that had earlier kept cheap footwear at five per cent disappeared.

Practical effect: From January 2022 to September 2025 every pair of footwear attracted twelve per cent regardless of price, and rate mistakes in that window are a common scrutiny point.

Westinghouse Saxby Farmer Ltd v. Commissioner of Central Excise, Calcutta — Supreme Court, AIR 2021 SC 1409, judgment dated 08-03-2021 · 2021-03-08

The Supreme Court held that relays manufactured solely for use in railway signalling equipment were classifiable under the chapter covering railway goods rather than the general electrical apparatus chapter. Circular No. 216/10/2024-GST · 2024-06-26

This circular amends and supplements the earlier warranty circular. It extends the treatment from replacement of parts to replacement of goods or their parts, so that a full product replacement under warranty is covered on the same basis, with no GST and no credit reversal. It also addresses the position where a distributor replaces goods out of its own stock and is later replenished by the manufacturer, and the treatment of extended warranty sold separately after the original supply.

Practical effect: Chennai dealers who swap out an entire defective product under warranty are now expressly covered, so no output tax or credit reversal is required.

The 40 percent rate is confined to luxury and demerit supplies. Can you give me a simple GST due-date calendar for my business?

How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation.
