The window for taking the benefit of the capped late fee on pending GSTR-3B returns for July 2017 to April 2021 was extended from 31 August 2021 to 30 November 2021. Response to the scheme had been strong but many taxpayers, particularly those whose registrations had been cancelled for non-filing, could not complete the exercise in three months. The extension was announced together with the extension of the revocation deadline so that the two reliefs could be used in sequence.

How we apply it: Returns for July 2017 to April 2021 filed up to 30 November 2021 attract only the capped fee, and any higher demand for those periods should be verified against the actual filing date.

Association maintenance taxed on the whole amount once the limit is crossed

TVH Lumbini Square Owners Association - AAR Tamil Nadu, Order No. 25/ARA/2019, dated 21 June 2019 · 2019-06-21

A residents welfare association collected monthly maintenance contributions from its members. The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. The Madras High Court subsequently held, in Greenwood Owners Association, that only the excess over Rs. 7,500 is taxable, and associations now follow that judicial position.

Practical effect: Chennai apartment associations should apply the High Court position carefully and keep member-wise workings ready for departmental scrutiny.

Eicher Motors Ltd v. Superintendent of GST and Central Excise — Madras High Court, 2024 · 2024-01-23

Eicher Motors had deposited tax amounts into its electronic cash ledger before the due dates but filed GSTR-3B belatedly owing to transitional credit issues, and the department demanded interest under Section 50. The Madras High Court held that once the amount is credited to the Government via the electronic cash ledger by the due date, the tax liability stands discharged to that extent, and no interest is leviable merely because the return was filed late. This reasoning has since been followed by other High Courts.

What it means for you: If cash was parked in your electronic cash ledger before the due date, contest any interest demand for delayed GSTR-3B filing on that amount.

A single price for naturally bundled components is a composite supply, taxed at the rate of the principal supply. For a coaching institute, coaching is the principal supply, so the entire lump sum, including printed materials and boarding provided as part of the package, attracts 18 percent. Printing separate invoices for books at nil rate out of a bundled fee is a known audit red flag and is routinely rejected. If the institute genuinely sells optional printed books to anyone at a separate price, those standalone sales can take the book's own treatment. Structure the fee schedule deliberately, not after the demand arrives.
When can I issue a GST credit note against my sales invoice?
Section 34 permits a credit note where the taxable value or tax charged in the invoice exceeds what is actually payable, where the goods are returned by the recipient, or where the goods or services are found deficient. The credit note references the original invoice, and reporting it in your GSTR-1 reduces your output tax liability for that period. It is the correct tool for sales returns, rate errors and quality claims. What a credit note cannot do is cancel an e-invoice after the twenty-four hour IRP window or rewrite history for a different customer; it must trace to a genuine adjustment on an identified invoice.
Swiggy and Zomato pay the GST on my restaurant orders. How do I show these sales in my returns?
Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. A client paid me an advance. Do I raise an invoice or something else?
On receiving an advance, you issue a receipt voucher under Rule 50, not an invoice; the tax invoice follows when the service is actually supplied. Advances for the supply of goods are not taxed at receipt for normal taxpayers under Notification 66/2017. How do I pay tax monthly under QRMP if the return is only quarterly?

Yes. Rule 18 of the CGST Rules requires every registered person to display the registration certificate in a prominent location at the principal place of business and every additional place, and to display the GSTIN on the name board at the entry of each such premises. There is no separate penalty provision for this lapse, so officers invoke the general penalty under Section 125, which can extend to Rs.25,000 under CGST with a matching state penalty. From 22 September 2025, beauty and physical well-being services, covering salons, barbers, beauty parlours, gyms, fitness centres and yoga institutes, attract 5 percent GST without input tax credit, reduced from the earlier 18 percent. The condition attached to the concessional rate is important: because credit is barred, the GST paid on your rent, equipment, cosmetics and consumables becomes part of your cost base.
