For the February, March and April 2020 tax periods CBIC lowered the interest rate on late GSTR-3B payment. Taxpayers with aggregate turnover above Rs 5 crore paid no interest for the first fifteen days after the due date and nine per cent thereafter, provided the return was filed by 24 June 2020. Taxpayers with turnover up to Rs 5 crore paid no interest at all if they filed within the extended dates specified for their turnover slab.
What it means for you: Interest demands for February to April 2020 must be recomputed under this concessional table, and many DRC-01 interest computations for that period are simply wrong.

The Supreme Court held that a rule prescribing a period within which credit must be taken from the date of the invoice does not take away any vested right. It merely regulates the manner and time of availing the credit, which the legislature is entitled to do. A taxpayer who fails to take the credit within the prescribed window loses the benefit. This reasoning supports the time limit in Section 16(4) of the CGST Act.
What to do about it: Chennai businesses should reconcile purchase registers with GSTR-2B every month and claim credit within the deadline, as belated claims are generally lost.

CBIC prescribed a uniform procedure for non-filers. A system-generated reminder goes out three days before the due date, followed by a notice in FORM GSTR-3A after the due date giving fifteen days to file. If the return is still not filed, the officer may assess the liability to the best of his judgment under section 62 and issue an order in FORM GST ASMT-13. That order is deemed withdrawn if the taxpayer files the valid return within thirty days of service.
What to do about it: An ASMT-13 best-judgment order is not the end; filing the missing return within the statutory window from service makes it fall away automatically.
