The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

Practical effect: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.

What is the due date for GSTR-3B in Tamil Nadu?
For monthly filers, GSTR-3B is due on the 20th of the following month. If you are registered in Tamil Nadu and have opted for the QRMP scheme, your quarterly GSTR-3B is due on the 22nd of the month following the quarter. GSTR-3B is the summary return through which you actually pay tax, so missing it attracts a late fee of Rs.50 per day (Rs.20 for nil returns) plus interest at 18 percent per annum on tax paid late.
How exactly do I pay RCM in my return and claim it back as credit?
Report the taxable value and tax in Table 3.1(d) of GSTR-3B; this liability must be discharged in cash through the electronic cash ledger, because input tax credit cannot be used to pay reverse charge dues. In the same return, claim the amount as ITC in Table 4(A)(2) or 4(A)(3), so the net impact is usually nil. RCM invoices from registered suppliers like GTAs appear in GSTR-2B, but credit for unregistered-supplier RCM rests on your self-invoice, and Circular 211/5/2024 confirms the Section 16(4) deadline runs from the year of that self-invoice. Advances for the supply of goods are not taxed at receipt for normal taxpayers under Notification 66/2017. If the rate is not determinable when the advance arrives, tax is paid at 18 percent, and if the nature of supply is not determinable, it is treated as inter-state. We hire security guards from an agency. Should they charge GST or should we pay it ourselves?
Check the agency's constitution. How does ITC reversal work for capital goods used for both taxable and exempt supplies?
Rule 43 treats every commonly used capital good as having a useful life of five years, so its total credit is spread over sixty months for reversal purposes. Each month, one-sixtieth of the credit on all common capital goods is attributed to the period, and the exempt proportion, computed on the exempt-to-total turnover ratio, is reversed in GSTR-3B with applicable interest treatment. Capital goods used exclusively for taxable supplies need no reversal, while those used exclusively for exempt supplies get no credit at all. Keep a capital goods register with commissioning dates, because the sixty-month clock and any change in use must be tracked asset-wise.
What is the 180-day payment rule for input tax credit?
Under the second proviso to Section 16(2) read with Rule 37, if you do not pay your supplier the invoice value including tax within 180 days from the invoice date, you must reverse the proportionate ITC in GSTR-3B, along with interest at 18 percent per annum from the date of availment. The credit can be re-availed, without any time limit, once payment is actually made. Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings.
