CBIC clarified that where a director rents out immovable property to the company in his personal capacity rather than as a director, the reverse charge entry for director's services does not apply and the ordinary forward charge rules govern. It also clarified that supply of food and beverages in cinema halls is taxable as a restaurant service at five per cent without input tax credit, unless the sale of the ticket and the food are clubbed as a composite supply with the ticket as the principal supply.
Practical effect: Companies paying rent to a director for personally owned premises need not discharge reverse charge under the director's-services entry, but must check the landlord's registration status.
GSTN Advisories dated 11 April 2025 and 16 May 2025 — Table 3.2 of GSTR-3B · 2025-04-11
GSTN first advised that from the April 2025 period, auto-populated values in Table 3.2 of GSTR-3B, covering inter-state supplies to unregistered persons, composition taxpayers and UIN holders, would become non-editable, with corrections routed through GSTR-1A. After taxpayer representations, a 16 May 2025 advisory kept Table 3.2 editable for the time being. The locking was later subsumed in the broader hard-locking of GSTR-3B liability during 2025.
How we apply it: Report place-of-supply details correctly in GSTR-1 itself, since state-wise B2C figures in GSTR-3B are moving beyond manual correction.
38th GST Council Meeting, New Delhi — 18 December 2019 · 2019-12-18
The Council waived late fee for taxpayers who furnished all pending statements of outward supplies in GSTR-1 for the tax periods from July 2017 to November 2019, provided they were filed by 10 January 2020. It also decided that e-way bill generation would be blocked for taxpayers who had not filed GSTR-1 for two tax periods, extending the blocking mechanism that already applied to GSTR-3B defaulters. Standard operating procedures were prescribed for officers dealing with non-filers, and Grievance Redressal Committees were set up at zonal and state level.
What to do about it: GSTR-1 default now carries its own e-way bill block, so filing GSTR-3B alone is not enough to keep despatches moving.
