The Council decided that the rate changes needed to correct the inverted duty structure in the footwear and textiles sectors, discussed and deferred at an earlier meeting, would be implemented with effect from 1 January 2022. The correction involved moving fabrics, garments and footwear below the earlier value thresholds from 5 per cent up to 12 per cent so that output tax would exceed input tax and refund claims would cease. The Council also set up Groups of Ministers on rate rationalisation and on using technology to improve compliance.

What it means for you: Tamil Nadu's textile and footwear clusters faced a five to twelve per cent increase from January 2022, a decision the Council reversed for textiles on 31 December 2021, the eve of implementation.

This notification amended Notification 08/2017-Central Tax (Rate) to extend the exemption from reverse charge on intra-State supplies received by a registered person from an unregistered supplier, moving the end date from 31 March 2018 to 30 June 2018. It was the first of several extensions granted while the Government considered how to redesign section 9(4) rather than let it revive in its original sweeping form.

You must apply for registration within thirty days of becoming liable, that is, within thirty days of the date your aggregate turnover crossed Rs.40 lakh for goods or Rs.20 lakh for services in Tamil Nadu. Registering late has consequences: tax becomes payable from the date liability arose, you cannot recover that GST from past customers, input credit for the unregistered gap is largely lost, and a penalty of Rs.10,000 or the tax evaded, whichever is higher, can apply. My credit notes this month exceed my sales. Can GSTR-3B show a negative figure?
Yes. Since the January 2024 tax period, the portal permits negative values in Table 3.1 of GSTR-3B where credit notes issued in a month exceed the outward supplies, a situation common in businesses with heavy sales returns. The resulting negative liability is carried forward automatically by the system and adjusted against the liability of subsequent tax periods, so you no longer need to defer reporting credit notes. What is the difference between core and non-core field amendments in GST?
Amendments to a GST registration are filed in Form REG-14, and the portal splits fields into two classes. Core fields include the legal name of the business, trade name, principal and additional places of business, and addition or deletion of promoters or partners; these need jurisdictional officer approval, normally granted within about fifteen working days, with deemed approval if the officer does not act. Non-core fields, such as bank details, authorised signatory changes, goods and services list, and state-specific details, are amended online and take effect immediately on submission without officer approval. In an exchange offer, a customer pays cash plus an old device. On what value do I charge GST?
On the full price of the new product before the exchange benefit. Where consideration is not wholly in money, Rule 27 of the valuation rules requires tax on the open market value of the supply, which in retail practice is the sticker price of the new phone or appliance; the old device taken in is part consideration, not a discount. My GST status shows suspended. What does that mean for my business in Tambaram?

Is there really a penalty for not displaying my GST number at my shop?
Yes. Rule 18 of the CGST Rules requires every registered person to display the registration certificate in a prominent location at the principal place of business and every additional place, and to display the GSTIN on the name board at the entry of each such premises. There is no separate penalty provision for this lapse, so officers invoke the general penalty under Section 125, which can extend to Rs.25,000 under CGST with a matching state penalty. Are any goods exempt from GST when transported by a GTA?
Yes. How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Consultants and agencies that bill quarterly should check their contracts against these rules, since late invoicing defers nothing legally.
If I open a bulk bag and sell rice loose by weight, is that sale taxable?
No. The 5% levy on specified food items applies only when they are supplied in pre-packaged and labelled form in packs up to 25 kilograms. When a retailer opens bulk stock and weighs out loose quantities against each customer's order, the supply is not of a pre-packaged commodity, so it remains exempt. What you cannot do is sell an intact labelled retail pack and bill it as loose. Keep purchase records showing bulk procurement and maintain the loose counter separately from the packed shelf, because officers test this distinction during inspections of grocery businesses. Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered.
