Hotel room rates linked to actual transaction value from 1 October 2019

Notification No. 20/2019-Central Tax (Rate) dated 30.09.2019 · 2019-09-30

This notification replaced the old declared tariff test for accommodation with the value of supply actually charged. From 1 October 2019 accommodation up to one thousand rupees per unit per day was exempt, above that and up to seven thousand five hundred rupees attracted 12 per cent, and above seven thousand five hundred rupees attracted 18 per cent. It also reduced outdoor catering at premises other than specified premises to 5 per cent without credit and rationalised several job work entries.

A five-judge Bench held that circulars issued by the Board cannot prevail over the statute, and are not binding on courts. Where the Supreme Court or a High Court has declared the law on an issue, that declaration prevails and any contrary circular ceases to have effect. Circulars remain an aid to administration and can bind officers, but they cannot enlarge or restrict what the legislature has enacted.

What to do about it: Chennai businesses should treat CBIC circulars as useful administrative guidance, but should not rely on one that conflicts with the plain words of the GST Act.

Use the GST Self-Service Grievance Redressal Portal at selfservice.gstsystem.in. Select Report Issue, type a keyword describing the problem, and the system suggests the matching category along with FAQs; if those do not resolve it, proceed to raise the ticket by entering your GSTIN or ARN, contact details and a description, and attach screenshots of the error. A ticket reference number is issued instantly by email and SMS. Raising a ticket also creates a record that the failure was on the system side, which helps later if a deadline was missed because of a portal outage. How do I register my DSC on the GST portal, and why does the emSigner error keep appearing?

Are hospital and clinic charges exempt from GST?

A practical point for traders: balances of unutilised compensation cess credit cannot be cross-utilised against CGST, SGST or IGST liability, so businesses holding old cess credit should evaluate their position rather than assuming it will set off future tax.
My GST status shows suspended. What does that mean for my business in Park Town?

Reinsurance of these policies is also exempt. Earlier these premiums bore 18 percent tax. Note that the exemption applies to policies taken by individuals; certain group covers procured by businesses can still attract GST, and insurers can no longer claim input credit attributable to exempt policies. Policyholders should see the benefit directly in renewal notices.
What are the current GST rate slabs after the GST 2.0 changes?
From 22 September 2025, following the 56th GST Council meeting, India moved to a simplified two-slab structure: a merit rate of 5 percent and a standard rate of 18 percent. The earlier 12 percent and 28 percent slabs were abolished. A special 40 percent rate applies to a short list of luxury and demerit goods, while the concessional rates of 3 percent on gold and silver and 0.25 percent on rough diamonds continue. Food ordered through e-commerce operators such as Swiggy and Zomato is taxed at 5 percent, with the platform liable to pay the tax on restaurant services supplied through it.
