A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

What it means for you: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

Swiggy and Zomato pay the GST on my restaurant orders. How do I show these sales in my returns?
Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. Do I have to report HSN codes in my GSTR-1?

Why is the portal not letting me file GSTR-1?
Under Rule 59(6) of the CGST Rules, the portal blocks GSTR-1 filing if the GSTR-3B of the preceding tax period has not been filed. GST returns are sequential, so a single skipped GSTR-3B stops the entire chain. The fix is to file the pending GSTR-3B along with its late fee and interest, after which GSTR-1 opens up again. My turnover is Rs.1.2 crore. Is GSTR-9 compulsory for me?
