The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

How we apply it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Single-agenda meeting on GST compensation offers states two borrowing options

The 41st meeting was convened with a single agenda item, GST compensation to states and union territories, after collections collapsed during the pandemic. The Centre placed before the Council two borrowing options for meeting the compensation shortfall for 2020-21: a special window facilitated by the Reserve Bank of India for the portion of the shortfall attributed to GST implementation itself, or market borrowing of the entire estimated shortfall by the states, in both cases serviced from future compensation cess collections. States were given a short period to convey their choice.

When can goods move on a delivery challan instead of a tax invoice?
Rule 55 permits movement on a delivery challan where the transportation is not itself a supply: sending inputs or capital goods for job work, taking goods to an exhibition or for approval where the sale is not yet certain, supplying liquid gas where the quantity is unknown at removal, and moving goods in semi-knocked-down form in multiple consignments, where the full invoice travels with the first lot. The challan is prepared in triplicate and an e-way bill is still required where value thresholds are crossed. Goods sent on approval must be invoiced within six months, failing which tax becomes payable.
Which food items became completely tax-free under GST 2.0?
From 22 September 2025, UHT milk, pre-packaged and labelled paneer and chena, and all Indian breads including roti, chapati, paratha and khakhra attract nil GST. In the pharma space, thirty-three notified lifesaving drugs and medicines for cancer and rare diseases also moved to nil rate. Remember that selling nil-rated goods still has compliance effects: you issue a bill of supply instead of a tax invoice for such items, and input tax credit attributable to nil-rated supplies must be reversed proportionately under Rules 42 and 43. What is the difference between the electronic cash ledger and the electronic credit ledger?
The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. Both are visible under Services, then Ledgers, after login. Refund of an excess cash balance is possible, while credit is refundable only in specified cases such as exports and inverted duty structure.
How do I track the status of a grievance ticket or any ARN I have on the GST portal?
For grievance tickets, open selfservice.gstsystem.in and use Check Status by entering the ticket reference number; the screen shows whether it is open, under processing or resolved, with the resolution comments. For applications filed on the main portal, log in and use Services, then Track Application Status, choosing the module and entering the ARN, or open My Applications to see every application with its case detail folder, notices and replies in one place. What are OIDAR services under GST and who pays the tax on them?
OIDAR means Online Information Database Access or Retrieval services, delivered over the internet, such as cloud services, e-books, streaming, online advertising and automated e-learning. When a foreign OIDAR provider supplies these to unregistered persons in India, the foreign provider itself must take a simplified registration in Form REG-10 and file monthly return GSTR-5A. From 1 October 2023, the definition was widened, so almost every unregistered Indian recipient is covered. When the Indian recipient is GST-registered, the tax instead falls on the recipient under reverse charge as an import of services.
What is the default place of supply rule for services within India?
Section 12(2) of the IGST Act sets the general rule for domestic services: if the recipient is registered, the place of supply is the recipient's location; if unregistered, it is the recipient's address on your records, and failing that, the supplier's own location. So a consultant in Siruseri advising a registered company in Hyderabad charges IGST, while the same advice to a local walk-in individual attracts CGST plus SGST. This default yields only to the specific rules for immovable property, events, transportation, and a few other categories, so always check whether a specific rule captures your service before falling back on the general one.

This covers diagnosis, treatment and care for illness, injury, deformity or pregnancy in any recognised system of medicine in India, and includes transportation of patients by ambulance, which is separately exempt for any provider. Consultation fees, surgery charges, nursing and diagnostic services within this definition carry no GST, which is why hospitals do not charge tax on treatment bills. The exemption attaches to the nature of the service, not the size of the hospital, so both a large corporate hospital and a single-doctor clinic are covered.
Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value. Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now. Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.
Which educational services are actually exempt from GST?
The exemption is confined to an educational institution as defined, meaning one providing pre-school education, education up to higher secondary school or equivalent, education as part of a curriculum for obtaining a qualification recognised by Indian law, or an approved vocational education course. Services by such institutions to their students, and specified input services to schools such as transport, catering and security, are exempt. Everything outside this boundary is taxable: private tuition, test preparation, hobby classes, skill courses without recognised certification, and training by ed-tech companies. The recognition of the qualification under Indian law is the decisive test, not the subject taught.
We hire cabs monthly for employee transport in Siruseri. Who pays the GST?
If the cab operator is not a body corporate, charges 5 percent, and your business is a body corporate, the liability shifts to you under reverse charge. The entry covers renting of motor vehicles designed to carry passengers where the cost of fuel is included in the consideration.
