The West Bengal Authority for Advance Ruling held that the exemption for renting a residential dwelling for use as a residence depends on the actual use of the premises and not on the status of the tenant, so the rent was exempt. From 18 July 2022 the exemption was withdrawn for renting to a registered person by Notification No. 04/2022-Central Tax (Rate) and the tax was placed on the registered tenant under reverse charge by Notification No. 05/2022-Central Tax (Rate).
