Notification No. 04/2022-Central Tax (Rate) dated 13.07.2022 · 2022-07-13
This notification amended the services exemption list to give effect to the 47th Council's decisions. Entry 12, which exempted renting of a residential dwelling for use as residence, was made subject to the condition that the recipient is not a registered person. The notification also withdrew the exemption for hotel accommodation priced up to one thousand rupees per unit per day and the value-based exemptions for small freight consignments carried by goods transport agencies. The changes took effect from 18 July 2022.
What it means for you: A Chennai landlord letting a flat to a GST-registered firm no longer supplies an exempt service, and the tenant must account for the tax under reverse charge.

Where a resolution plan is approved by the adjudicating authority under the Insolvency and Bankruptcy Code and the government's claim is scaled down, the tax department cannot continue to pursue the original demand. The Board directed officers to give effect to the approved plan by issuing an intimation in FORM GST DRC-25 under Rule 161, reducing the demand in the recovery records to the amount admitted in the plan, and to close recovery proceedings for the balance.
What to do about it: If a Chennai company has come out of insolvency, insist on a DRC-25 intimation so that the old demand stops appearing in the recovery register and blocking registration or refunds.

The Council reduced GST on all electric vehicles from 12 per cent to 5 per cent and on chargers or charging stations for electric vehicles from 18 per cent to 5 per cent. Hiring of electric buses with carrying capacity of more than twelve passengers by local authorities was exempted. All these changes took effect from 1 August 2019. The Council also extended the last date for opting into the six per cent service composition scheme in CMP-02 to 30 September 2019.
What it means for you: Electric vehicle dealers and charging point operators in Chennai bill at five per cent, a rate that has survived every later rate revision including GST 2.0.
