The Bank of Nova Scotia - AAR Tamil Nadu, Order No. TN/23/AAR/2018, dated 31 December 2018 · 2018-12-31

The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

Practical effect: Chennai importers using FTWZ facilities pay IGST once at clearance and should resist any demand for a second levy on removal.

Electric vehicles stay at 5 per cent while petrol and diesel cars move to 18 or 40

Notification No. 9/2025-Central Tax (Rate), dated 17 September 2025, Schedule I entries for electrically operated vehicles and chargers · 2025-09-17

Electrically operated vehicles including two-wheelers and three-wheelers, fuel cell and hydrogen vehicles, e-bicycles and chargers or charging stations for electric vehicles remain in Schedule I at five per cent. Small petrol cars up to 1200 cc and up to 4000 mm, small diesel cars up to 1500 cc and up to 4000 mm and motorcycles up to 350 cc moved to eighteen per cent, while larger cars, hybrids above those limits and motorcycles above 350 cc were placed at forty per cent.

What to do about it: The tax gap between an electric two-wheeler at five per cent and a petrol motorcycle at eighteen per cent is now the single biggest pricing lever for Chennai vehicle dealers.

An importer of toys challenged seizure and prohibition orders issued during a GST inspection. The Madras High Court partly allowed the petition, sustaining the seizure but modifying the prohibition order and directing provisional release of the goods on a personal bond plus a deposit of Rs. 2 lakh. The Court noted that the officers had not produced the material on which their reason to believe was founded, and took into account the severe business disruption caused by the pandemic.

Practical effect: Seized stock can often be released provisionally on bond and a modest deposit while the investigation continues, instead of remaining locked up indefinitely.

Is GST still charged on health insurance premiums?
Not on individual policies. With effect from 22 September 2025, premiums on all individual life insurance policies and individual health insurance policies, including family floater and senior citizen plans, are exempt from GST, along with their reinsurance. Earlier these attracted 18 percent, so the change directly reduces the premium outgo for households. Group policies taken by businesses for employees continue to be taxable, and the input tax credit position on such group covers still depends on whether the cover is statutorily obligatory. When renewing policies, check that the insurer has passed on the exemption rather than merely repricing the premium.
Is GST payable on hostel or paying guest accommodation in KK Nagar?
A specific exemption effective 15 July 2024 covers accommodation services supplied at a value up to Rs.20,000 per person per month, provided the accommodation is supplied for a minimum continuous period of ninety days. Student hostels and working men's or women's PGs in KK Nagar charging within this limit for long stays are therefore exempt. Yes, within limits. Under Section 49(10), unutilised IGST and CGST balances in the electronic cash ledger can be transferred through PMT-09 to the cash ledger of a distinct person, that is, another GSTIN registered on the same PAN in the same or another state. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register. Multi-state businesses headquartered in KK Nagar use this to shift idle deposits to the branch that actually needs the cash, avoiding fresh working capital outflow.
Which food items became completely tax-free under GST 2.0?

Should I claim a refund of my accumulated ITC or just carry it forward?
Carry-forward suits businesses whose future output tax will absorb the credit within a few months, since it avoids refund paperwork. A refund makes sense when the credit keeps growing and will never be absorbed, which is typical for exporters under LUT and businesses with inverted duty structure, because idle credit is interest-free money locked with the government. Remember that refunds are only available in categories permitted by Section 54; ordinary accumulated credit from slow sales cannot be refunded. A quick review of your credit ledger trend over six months usually makes the right answer obvious.
What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. The document series you use must also be declared in Table 13 of GSTR-1 each period.
What is the difference between the electronic cash ledger and the electronic credit ledger?
The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. Both are visible under Services, then Ledgers, after login. Refund of an excess cash balance is possible, while credit is refundable only in specified cases such as exports and inverted duty structure.
I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Event managers and contractors see cancellations regularly, and using the wrong document between these two is a common reconciliation error.
We pay for foreign software subscriptions and overseas consultants. Is GST payable in India?
Yes. Import of services, meaning services from a supplier located outside India received by a person in India for business, attracts IGST under reverse charge in the recipient's hands, payable in cash and claimable as ITC if eligible. This catches cloud software, foreign professional fees, overseas advertising and licence fees. Two nuances matter: services from a related foreign party, such as your parent company, are taxable even without consideration under Schedule I, and OIDAR services supplied to unregistered consumers are taxed in the foreign supplier's own hands, not under RCM. What GST do hotels charge on room tariffs after the 2025 rate changes?
From 22 September 2025, hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, and accommodation above Rs.7,500 attracts 18 percent with input tax credit. The earlier 12 percent slab for mid-range rooms was abolished in the rate rationalisation. Tax applies on the actual transaction value charged, so a discounted rate below Rs.7,500 falls in the 5 percent bracket even if the printed tariff is higher. Hotels should reconfigure billing software slab-wise and watch the ITC restriction on the 5 percent category, which changes costing materially.
