The applicant prepared food and served it in the canteens of client companies at their premises. It sought the rate applicable to this arrangement. The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.

Practical effect: Chennai canteen contractors should bill factory and office canteens at 5 percent and forgo input tax credit on their purchases.

Dynamic QR code made compulsory on B2C invoices of large suppliers

Notification No. 14/2020-Central Tax · 2020-03-21

Registered persons with aggregate turnover above Rs 500 crore were required to print a dynamic quick response code on invoices issued to unregistered consumers, so that the customer could scan and pay digitally. Where the payment is made through a prescribed dynamic QR code, the cross-reference of that payment on the invoice is treated as compliance. The same exclusions as e-invoicing apply. The start date was pushed from 1 April 2020 to 1 October 2020 and then to 1 December 2020.

What to do about it: Only very large retailers are covered, so an ordinary Chennai shop or restaurant has no dynamic QR code obligation on its cash-counter bills.

No late fee applies to a delayed PMT-06 deposit, because late fee is linked only to returns. However, interest at 18 percent per annum is payable on the shortfall for the delay period. Note that if you used the fixed sum method and paid the pre-filled 35 percent amount on time, no interest applies for the first two months even if actual liability was higher, provided the balance is paid in the quarterly GSTR-3B by its due date. What is the QRMP scheme and can my business opt for it?
QRMP stands for Quarterly Return filing and Monthly Payment. Taxpayers with aggregate turnover up to Rs.5 crore in the preceding financial year can opt in. Under the scheme you file GSTR-1 and GSTR-3B once a quarter instead of every month, but you still pay tax monthly through challan PMT-06 for the first two months of the quarter.
