Rich Dairy Products (India) Pvt Ltd - AAR Tamil Nadu (2019), upheld by AAAR Tamil Nadu, Order No. TN/AAAR/01/2020 · 2019

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

Why this matters: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.

The Council recommended reducing the GST rate from 28 to 18 per cent on goods falling in 178 headings at the four-digit level, including four headings only partially pruned, so that the 28 per cent list fell from 224 tariff headings to only about 50. Further reductions were recommended from 28 to 12 per cent, from 18 to 12 per cent and from 18 to 5 per cent on specified goods, together with relief for the aviation and handicraft sectors and restaurants.

Practical effect: This is the single largest rate rationalisation of the early GST years and reset the price and credit position for most Chennai consumer goods dealers overnight.

Electrically operated vehicles including two-wheelers and three-wheelers, fuel cell and hydrogen vehicles, e-bicycles and chargers or charging stations for electric vehicles remain in Schedule I at five per cent. Small petrol cars up to 1200 cc and up to 4000 mm, small diesel cars up to 1500 cc and up to 4000 mm and motorcycles up to 350 cc moved to eighteen per cent, while larger cars, hybrids above those limits and motorcycles above 350 cc were placed at forty per cent.

Yes. Late fee for GSTR-1 is Rs.50 per day of delay, and Rs.20 per day where there are no outward supplies, subject to caps linked to your turnover. Although the portal historically collected GSTR-1 late fees through the next GSTR-3B, the liability arises the moment the due date passes. What is the late fee if I file a nil return late?
For a nil GSTR-3B or nil GSTR-1 filed after the due date, the late fee is Rs.20 per day of delay (Rs.10 CGST plus Rs.10 SGST), capped at Rs.500 per return (Rs.250 plus Rs.250). No interest applies since there is no tax payable. While Rs.500 sounds small, defaults across several months add up, and the bigger cost is the compliance chain breaking and your GSTIN being flagged. What is the electronic liability register on the GST portal and why should I check it?
The electronic liability register, maintained in Form PMT-01, records every liability raised against your GSTIN: self-assessed tax from returns in Part I, and demands from assessments, adjudication orders and DRC-07 summaries in Part II.
