The Appellate Authority upheld that view.

Following the 56th GST Council meeting, CBIC clarified the treatment of secondary and post-sale discounts. Where a supplier issues a financial or commercial credit note without adjusting GST, the dealer need not reverse input tax credit, since the tax originally charged stands unchanged. Discounts given to dealers are not consideration for any service by the dealer merely because they aid sales, unless a specific agreement obliges the dealer to perform defined promotional activities for separate consideration.

Rules 89(4A) and 89(4B) prescribed a restrictive formula for their credit refunds. All three were omitted with prospective effect from 8 October 2024, removing a provision that had generated a large volume of recovery notices against exporters.

What imprisonment terms does GST law prescribe, and which offences are non-bailable?
