Trade Profile and GST Jurisdiction for Santhome

Every locality in Chennai has its own commercial rhythm, and Santhome is no exception. Santhome stretches from the Light House end of Marina down Santhome High Road past San Thome Basilica, mixing schools such as St. Bede's, church-linked institutions, neighbourhood retail and the fishing settlement of Nochikuppam along Loop Road. Fresh fish sales are GST-exempt, but ice, packing and transport attract tax, so fisherfolk cooperatives and seafood sellers here need careful exempt-versus-taxable classification. Our practice has shaped its DRC-01/DRC-01A Demand Reply work around exactly these realities, serving clients in Santhome as well as Mylapore and Foreshore Estate. Registrations, returns, refunds and notice replies are handled by one accountable team, with fees fixed in writing before work begins and every filing reconciled against portal data before it is submitted.

GST jurisdiction for Santhome (PIN 600004): businesses here generally fall under the CGST Chennai North Commissionerate. We regularly represent clients from Santhome before this jurisdiction for registrations, clarifications and notice hearings, and can confirm your exact division and range from your GSTIN. State-jurisdiction cases are handled with the Tamil Nadu Commercial Taxes Department.
GST for IT and SaaS Companies in Santhome
IT and SaaS services are taxed at 18 percent domestically, but the real complexity is qualifying overseas billing as export under Section 2(6) of the IGST Act: the recipient must be outside India, consideration must arrive in convertible foreign exchange or INR where RBI permits, and the Indian entity and foreign recipient must not be mere establishments of the same person. Marketing or support arms serving a foreign parent risk classification as intermediaries under Section 13(8), making the place of supply India and the income taxable. Supplies to SEZ units are zero-rated with proper endorsements. A specialist structures contracts and invoicing so export status survives departmental scrutiny.
For DRC-01/DRC-01A Demand Reply in Santhome, you typically need your PAN, Aadhaar, business address proof, bank details and relevant invoices; the exact checklist is shared on WhatsApp and fees start at Rs.4,999.
Why Us

Why Santhome Businesses Choose ChennaiGST

Not a bulk-filing portal. A senior consultant knows your file, your jurisdiction and your deadlines.

✓

Cancelled GSTIN? We Handle Revocation Too

A registration cancelled for non-filing is not the end of the road. We bring the pending returns up to date, clear the dues and file the revocation application in REG-21 within the permitted window, restoring suspended and cancelled GSTINs to active status.

✓

Deadline Tracking Done for You

GSTR-1 by the 11th, GSTR-3B by the 20th, CMP-08 by the 18th after each quarter — we maintain a compliance calendar for every client and start chasing your data well before the due date, so late fees never enter the picture.

✓

Waiver and Amnesty Windows Applied for You

Whenever the GST Council notifies a late-fee waiver or an amnesty window for pending returns or old demands, we check every client's history against it and act within the deadline. Relief that businesses in Santhome would otherwise read about after it lapsed reaches our clients in time.

✓

One Dedicated Point of Contact

You deal with one accountable person who knows your business, your turnover pattern and your filing history. No repeating your story to a new voice every month, and no file falling between two desks when a deadline is approaching.

✓

Multi-GSTIN and Branch Coordination

Businesses with registrations in more than one State, or multiple branches under one PAN, face cross-charge, stock transfer and input service distribution questions that single-GSTIN firms never see. We keep all your registrations consistent with each other, not just compliant individually.

✓

Fast, Clean Registrations and Amendments

New GSTIN applications, core field amendments through REG-14, additional places of business — we prepare complete, query-resistant applications the first time. Clean paperwork is the difference between smooth approval and weeks lost answering clarification memos from the department.

How It Works

Our Demand Reply Process

Demand analysis

We examine whether the notice is under Section 73 or 74, check the limitation period, and break the demand into issues that can be defended separately.

Merits assessment

Each issue is tested against your records, GSTR-2B and case law, and we give you a candid view of what is defensible and what is genuinely payable.

DRC-06 reply drafting

A detailed statutory reply is drafted in Form DRC-06 with reconciliations, invoices and legal grounds, shared for your approval and filed on the portal in time.

Hearing and payment strategy

We represent you at the personal hearing. For any admitted liability we file DRC-03 promptly, using the concessional closure available under Section 73 where applicable.

Order and next steps

We track the adjudication outcome, review any order in DRC-07, and advise on rectification or appeal in APL-01 within three months if the demand is confirmed.

Why a Specialist Matters

With ChennaiGST vs Doing It Yourself

AspectWith ChennaiGSTDIY / Unattended
Portal credentials and dataLogins handled by a small engaged team under strict confidentiality, with credentials stored securely and never passed onward.Passwords circulating on chats with freelancers and part-timers, and no accountability for who has accessed your business data.
Refund claimsRFD-01 filed with complete statements and annexures, tracked from ARN to bank credit, with any deficiency memo answered promptly.Incomplete claims bounce back as deficiency memos while the refund sits unclaimed for months and working capital stays blocked.
When a notice arrivesA professional drafts the reply in the department's format and files it within the statutory window, such as thirty days for ASMT-11.You face departmental language alone, and a missed reply deadline can convert a simple query into a demand with penalty.
Keeping up with changesRate changes, portal updates and new thresholds such as the Rs.5 crore e-invoice limit are tracked by us and applied to your case proactively.Changes are discovered after the fact — often through a rejected filing, a blocked e-way bill or a departmental letter.
Time costRoughly an hour a month to send data and approve drafts; the portal work, reconciliation and follow-up are ours.Hours every month lost to portal errors, JSON files, OTP failures and reworking figures — usually on the due date itself.
Risk of noticesGSTR-1, GSTR-3B and GSTR-2B reconciled before filing, removing the mismatches that trigger most scrutiny notices.Inconsistent figures across returns quietly build a mismatch history that surfaces later as ASMT-10 scrutiny or a demand notice.
Law Update

GST Rulings and Notifications That Affect You — relevant to Santhome businesses

GST law moves through notifications, circulars and court decisions. These are the ones changing how filings are prepared right now.

Circular

Electric vehicles without batteries and other rate clarifications

Circular No. 179/11/2022-GST, dated 3 August 2022 · 2022-08-03

Implementing the 47th GST Council recommendations, CBIC clarified that an electrically operated vehicle attracts the concessional five per cent rate whether or not it is fitted with a battery pack at the time of supply, ending a dispute that had hurt manufacturers using battery-swapping models. The circular also addressed the classification of fly ash bricks and blocks, by-products of milling of pulses and dal such as chilka and khanda, treated sewage water, and nicotine polacrilex gum.

How we apply it: Electric vehicle sellers should not be forced into eighteen per cent merely because the battery is billed or leased separately, and this circular is the answer to such a notice.

Case Law

Madras High Court: no Section 50 interest where tax was deposited in the electronic cash ledger by the due date

Eicher Motors Ltd v. Superintendent of GST and Central Excise — Madras High Court, 2024 · 2024-01-23

Eicher Motors had deposited tax amounts into its electronic cash ledger before the due dates but filed GSTR-3B belatedly owing to transitional credit issues, and the department demanded interest under Section 50. The Madras High Court held that once the amount is credited to the Government via the electronic cash ledger by the due date, the tax liability stands discharged to that extent, and no interest is leviable merely because the return was filed late. This reasoning has since been followed by other High Courts.

Why this matters: If cash was parked in your electronic cash ledger before the due date, contest any interest demand for delayed GSTR-3B filing on that amount.

Notification

Rule 88C and Form DRC-01B: explaining the GSTR-1 versus GSTR-3B liability gap

Rule 88C, CGST Rules, 2017, inserted by Notification No. 26/2022-Central Tax · 2022-12-26

Rule 88C requires the portal to intimate a taxpayer in Form GST DRC-01B whenever the output tax liability declared in GSTR-1 for a period exceeds the liability paid through GSTR-3B beyond the prescribed limit. The taxpayer must either pay the shortfall with interest through Form DRC-03 or furnish an explanation in Part B of DRC-01B within seven days. The facility went live on the portal from mid-2023 and an unanswered intimation blocks the next GSTR-1.

What it means for you: Reconcile GSTR-1 against GSTR-3B every month, because a DRC-01B intimation left unanswered for seven days will freeze your next outward supplies return.

Already Holding the Notice? Read It in About a Minute

Upload the PDF to our free GST Notice Analyser. It identifies which of 34 notice types you have, pulls out the DIN, GSTIN and tax period, reads the reply date printed on the notice and tells you plainly whether that date has already passed — along with the documents and reconciliations you will need. No payment, no account. If the notice does not state a date we can read, it says so rather than guessing one for you.

Analyse my notice — free WhatsApp it to a consultant

The analyser reports what your notice says and the statutory position for that form. It is not a substitute for a consultant reading your actual records, and a reply should be reviewed before you file it.

FAQs

Frequently Asked Questions

Straight answers from practising GST consultants — based on the CGST Act, current CBIC notifications and day-to-day portal experience.

Is there a GST consultant near Santhome for drc 01 notice reply?
Yes. We serve Santhome and the surrounding areas from our office at Porur, Chennai - 600 116, Tamil Nadu, and most demand reply work is completed online — you send documents on WhatsApp and we handle the portal work. If you prefer in-person help, we offer doorstep document pickup across Santhome and you are welcome to visit our office. Reach us on +91 - 9600 606 444 between 9 AM and 8 PM, Monday to Saturday.
How much does DRC-01/DRC-01A demand reply cost in Santhome?
Our fee for DRC-01/DRC-01A demand reply in Santhome starts at Rs.4,999 and is quoted in full before we begin — there are no hidden charges added later. The fee covers professional work end to end: document review, preparation, filing and follow-up until completion. Government fees or portal charges, where applicable, are separate and always shown to you upfront. For an exact quote based on your turnover and business type, call +91 - 9600 606 444 and a consultant will confirm it on the call.
I received Form DRC-07 after an adjudication order. What happens next?
DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths. Either pay the demand, or file an appeal in Form APL-01 within three months of the order with a pre-deposit of 10 percent of the disputed tax, which stays recovery of the balance. If you do nothing, recovery action, including bank account attachment, can begin three months after the order, and even earlier in exceptional cases. Do not let the appeal window lapse; call +91 - 9600 606 444 for an urgent review of the order.
What is the difference between DRC-01A and DRC-01 in GST?
DRC-01A is a pre-show-cause intimation. In Part A the officer communicates the tax, interest and penalty he has ascertained and gives you a chance to pay or explain before formal proceedings begin; you can respond through Part B of the same form. DRC-01, by contrast, is the summary of a formal show cause notice under Section 73 or Section 74, which starts adjudication and must be answered in Form DRC-06. Handling the DRC-01A stage well can close a matter quietly, whereas a DRC-01 requires a full legal defence. Send us the document on +91 - 9600 606 444 and we will tell you which stage you are at.
How do I reply to a DRC-01 show cause notice online?
The reply to a show cause notice summarised in DRC-01 is filed in Form DRC-06 on the GST portal. Log in, open View Additional Notices and Orders, select the case and use the reply option to upload your written submissions and supporting documents, and opt for a personal hearing. A good DRC-06 addresses each allegation separately, annexes reconciliations, invoices and ledgers, cites the relevant provisions and circulars, and raises limitation and jurisdiction objections where available. File within the time allowed in the notice. ChennaiGST drafts DRC-06 replies for Santhome businesses with a hearing strategy built in from the start.
Can I use my input tax credit balance to pay a DRC-03 liability?
Partly. The tax component of a DRC-03 payment can be settled from the electronic credit ledger, subject to the usual cross-utilisation rules between IGST, CGST and SGST. However, interest, penalty and late fee can never be paid from credit; those components must come from the electronic cash ledger, so you may need to deposit a challan first. The portal shows both ledger balances on the payment screen and lets you split the utilisation. Planning this split correctly avoids depositing cash unnecessarily when credit is lying idle, which is a routine saving we make for clients every month.
I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?
Start with a supplier-wise reconciliation identifying why each credit is missing from GSTR-2A, such as the supplier filing late, quoting a wrong GSTIN or reporting B2B supplies as B2C. For FY 2017-18 and 2018-19, CBIC Circular 183/15/2022 permits proving genuine credits through supplier certificates or CA certificates, which resolves many Santhome cases. Attach tax invoices, payment proofs and ledger extracts to your DRC-06 reply to establish that the conditions of Section 16 were met. Where a supplier has genuinely defaulted, quantify and pay only that portion through DRC-03 rather than conceding the entire demand.
Can the penalty in a Section 74 fraud case be reduced by paying early?
Yes, Section 74 has a built-in incentive to settle early. If you pay the tax and interest before the show cause notice is issued, the penalty is 15 percent of the tax. If you pay within thirty days of the notice, penalty is 25 percent and the proceedings conclude. Even after the order, paying within thirty days limits penalty to 50 percent instead of 100 percent. Payments are made in DRC-03 with the correct cause selected. Whether to settle or contest depends on the strength of the fraud allegation, so have the notice evaluated professionally before choosing; call +91 - 9600 606 444 for an assessment.
Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
How many days do I get to reply to an ASMT-10 notice?
The reply in Form ASMT-11 must be filed within thirty days of being informed of the discrepancies, or within such further time as the officer permits. If you need more time to gather reconciliations, write to the officer seeking an extension before the deadline instead of staying silent. The thirty days pass quickly because a proper reply needs invoice-level matching of GSTR-1, GSTR-3B, GSTR-2B and your books, so start compiling data the day the notice arrives. ChennaiGST typically completes the reconciliation and files the ASMT-11 well within the window for Santhome clients; call +91 - 9600 606 444 if your deadline is close.
At what amount of tax evasion can GST prosecution be launched?
Following the Finance Act 2023 amendments, prosecution under Section 132 is generally launched only where the amount of tax evaded, or input tax credit wrongly availed or utilised, exceeds Rs.2 crore, raised from the earlier Rs.1 crore. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
Why is my e-way bill generation blocked on the portal?
Under Rule 138E, the e-way bill facility is blocked when a taxpayer has not filed GSTR-3B (or CMP-08 for composition dealers) for two or more consecutive tax periods. Since an e-way bill is mandatory for moving goods worth more than Rs.50,000, blocking effectively halts dispatches. The remedy is straightforward: file the pending returns with late fee and interest, after which the facility unblocks automatically, usually the next day. Transporters and suppliers can also be affected when a counterparty GSTIN is blocked. We clear return backlogs for businesses in Santhome on priority; call +91 - 9600 606 444.
What GST rate applies to cars and two-wheelers now?
Small cars, meaning petrol cars up to 1200cc and diesel cars up to 1500cc with length not exceeding 4 metres, attract 18 percent GST, down sharply from the earlier 28 percent plus cess. Larger cars, SUVs above these specifications, attract the 40 percent rate, but with the compensation cess gone, the overall burden on most of them is still lower than before. Motorcycles up to 350cc are at 18 percent, while those above 350cc attract 40 percent. Electric vehicles continue at a concessional 5 percent. Dealers must also apply these rates to demo vehicle sales.
I buy electronics stock from distributors in other states. How does the IGST on purchases work for me?
Inter-state purchases carry IGST, which flows into your GSTR-2B once the distributor files GSTR-1, and it is fully available as input tax credit. When you sell locally in Tamil Nadu you charge CGST and SGST, and the law lets you use IGST credit against both, with the portal applying the set-off order automatically. There is no cost disadvantage in buying from out-of-state distributors, provided they are compliant filers; a distributor who files late delays your credit by a month. Track supplier filing discipline as part of vendor selection. Retailers in Santhome can call +91 - 9600 606 444 for a supplier compliance scorecard.
How do I register my DSC on the GST portal, and why does the emSigner error keep appearing?
After logging in, open My Profile and select Register or Update DSC, choose the authorised signatory's PAN, and sign with the USB token; the certificate must be Class 3 and the PAN on it must match the signatory's PAN on the portal. Signing requires the emSigner utility running in the background, and the common failure to establish connection error means emSigner is not started, is blocked by the browser, or another application occupies its port. Run emSigner as administrator, keep the token connected, and use the trusted-site settings the portal recommends. We troubleshoot DSC issues for Santhome companies routinely; call +91 - 9600 606 444.
What documents must I prepare for reverse charge purchases from unregistered suppliers?
Two documents are required. First, a self-invoice: Section 31(3)(f) obliges you to issue an invoice on yourself for goods or services received from an unregistered supplier on which you pay tax under reverse charge, and under Rule 47A this self-invoice must be issued within thirty days of receiving the supply. Second, a payment voucher under Rule 52 at the time of making payment to the supplier. The self-invoice is the document on which you claim the input tax credit of the reverse charge tax paid. Freight from unregistered transporters and advocate fees are typical cases where businesses miss this paperwork.
How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Consultants and agencies that bill quarterly should check their contracts against these rules, since late invoicing defers nothing legally.
What are OIDAR services under GST and who pays the tax on them?
OIDAR means Online Information Database Access or Retrieval services, delivered over the internet, such as cloud services, e-books, streaming, online advertising and automated e-learning. When a foreign OIDAR provider supplies these to unregistered persons in India, the foreign provider itself must take a simplified registration in Form REG-10 and file monthly return GSTR-5A. From 1 October 2023, the definition was widened, so almost every unregistered Indian recipient is covered. When the Indian recipient is GST-registered, the tax instead falls on the recipient under reverse charge as an import of services.
