GSTN Advisory, 2023 — e-invoice enablement status and self-enablement on einvoice.gst.gov.in · 2023
GSTN clarified that the enablement status shown on the e-invoice portal is only a system facility and does not decide whether a taxpayer is legally required to issue e-invoices. A taxpayer whose aggregate turnover crossed the prescribed limit in any financial year from 2017-18 onwards must issue e-invoices for business-to-business supplies and for exports, and where the portal does not already show the GSTIN as enabled, the taxpayer can self-enable on the portal. Notified exempt classes such as banks, insurers and passenger transport operators remain outside the requirement.
Practical effect: Test turnover for every year since 2017-18 against the e-invoice threshold and self-enable, because not being enabled on the portal is no defence in an audit.

A residents welfare association collected monthly maintenance contributions from its members. The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. The Madras High Court subsequently held, in Greenwood Owners Association, that only the excess over Rs. 7,500 is taxable, and associations now follow that judicial position.
Why this matters: Chennai apartment associations should apply the High Court position carefully and keep member-wise workings ready for departmental scrutiny.

The parent e-invoicing notification was amended to substitute Rs 50 crore for Rs 100 crore, bringing registered persons with aggregate turnover above Rs 50 crore into the system with effect from 1 April 2021. This third phase captured a large number of mid-sized manufacturers, distributors and service providers for the first time. The turnover test continued to look at any financial year from 2017-18 onwards, and the existing sectoral exclusions were untouched.
