Filing of appeals is mandatorily electronic, and advisories prescribe a phased, staggered schedule so that the backlog does not congest the system, with backlog appeals against pre-existing orders permitted to be filed up to 30 June 2026.

Education exemption is limited to recognised institutions, not coaching centres

Entry 66, Notification No. 12/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28

Entry 66 exempts services supplied by an educational institution to its students, faculty and staff, and services relating to admission to or conduct of examinations. It also exempts transportation of students, catering including any government-sponsored mid-day meal scheme, security, cleaning and housekeeping supplied to an institution, but only where that institution provides education up to higher secondary level. An educational institution is one whose output leads to a qualification recognised by law, so private coaching classes fall outside the exemption.

Why this matters: A Chennai coaching centre or competitive-exam institute is fully taxable, while a recognised school or college is exempt, and the two must never be treated alike.

I discovered an old ASMT-13 order only after the return-filing window closed. What can I do now?
Once the sixty-day window and the further sixty-day extended window under Section 62 have both lapsed, filing the return no longer withdraws the order, and the estimated demand in the liability register becomes recoverable. Your remedy shifts to an appeal in Form APL-01 within three months of the order's communication, with the prescribed pre-deposit, arguing the actual figures from your books against the officer's estimate. Appellate authorities regularly scale down best judgment estimates when the genuine return data is placed on record. Apart from the pre-deposit, is there any court fee for filing a GST first appeal?
No separate court fee or filing fee is charged for an appeal in Form APL-01; the only statutory outflow is the pre-deposit, being the admitted amount in full plus 10 percent of the disputed tax. The law also caps the pre-deposit: with effect from 1 November 2024, the ceiling for a first appeal is Rs.20 crore each under CGST and SGST, reduced from the earlier Rs.25 crore. What happens after I file Form APL-01 on the GST portal?

An appeal to the GST Appellate Tribunal requires payment of the admitted dues in full plus an additional pre-deposit of 10 percent of the disputed tax, over and above the 10 percent already paid at the first appeal stage. Following the Finance (No. 2) Act 2024 amendments effective 1 November 2024, this additional deposit was reduced from the earlier 20 percent, and is capped at Rs.20 crore each under CGST and SGST. On payment, recovery of the balance demand stays until the Tribunal decides. With the Tribunal benches now being operationalised, orders in limbo for years can finally be tested; keep certified copies of every order ready.
Which GST orders can I appeal against?
Any decision or order passed by an adjudicating authority under the GST Acts can be appealed in Form APL-01. Common examples are demand orders under Section 73 or 74 summarised in DRC-07, registration cancellation orders in REG-19, refund rejection orders in RFD-06, best judgment assessment orders in ASMT-13, and penalty orders, including detention cases involving e-way bill lapses. A few matters are excluded, such as orders on transfer of proceedings and seizure directions. How much time does the GST department have to issue a demand under Section 73?
For a Section 73 demand, the adjudication order must be passed within three years from the due date of the annual return for the financial year concerned, and the show cause notice must be issued at least three months before that deadline. For Section 74 fraud cases, the order deadline is five years with the notice issued at least six months earlier. For tax periods from FY 2024-25 onwards, a new common provision in Section 74A applies with its own timelines. Always check limitation first; notices issued beyond these dates can be challenged as time-barred, which ChennaiGST examines in every Chintadripet demand case.
I applied for GST registration in Chintadripet and received a REG-03 notice. What does it mean?
Form REG-03 is a notice seeking clarification on your GST registration application. The officer may question your proof of principal place of business, promoter identity documents or the nature of business declared. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. In simple terms, the invoice must travel with the goods; a lorry leaving your Chintadripet godown without an invoice is exposed to detention even if the e-way bill exists. For continuous supplies of goods with successive statements or payments, the invoice must be issued when each statement is issued or each payment is received.
My customer in Mumbai asked me to deliver goods directly to his buyer in Chintadripet. How do I bill this?
This is a bill-to ship-to transaction under Section 10(1)(b). When goods are delivered to a third party on the instruction of your customer, the law deems your customer's principal place of business as the place of supply, not the actual delivery point. I am a composition dealer. Which returns apply to me and when?
Composition taxpayers do not file GSTR-1 or GSTR-3B. Instead, you pay tax every quarter through statement CMP-08, due by the 18th of the month following the quarter, and file one annual return, GSTR-4, by 30 June following the financial year. The scheme is available for turnover up to Rs.1.5 crore for goods, with a separate 6 percent scheme for service providers up to Rs.50 lakh. Is GST applicable on rent for my shop or office premises?
Yes. Renting of commercial property such as shops, offices, godowns and industrial sheds is a taxable supply of services at 18 percent, charged by the landlord under forward charge once the landlord's aggregate turnover, including this rent, crosses Rs.20 lakh. The tenant, if registered and using the premises for business, can claim the GST as input tax credit, since renting is not a blocked credit. Landlords with several small commercial properties often cross the threshold without realising it, because rent from all properties on the same PAN is clubbed. A yearly turnover check protects against retrospective demands.
Can my GST registration be cancelled for not filing returns?
Yes. Under Rule 21A, the department can suspend a GSTIN where returns are not filed for a continuous period, and Section 29 permits cancellation where a regular taxpayer has not filed returns for six months (two quarters for QRMP, and a composition taxpayer defaulting on the annual return beyond three months). During suspension you cannot issue tax invoices or file returns, which freezes the business. If cancellation happens, revocation must be sought through REG-21 within 90 days after clearing all dues.
