The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

GSTN advised that return data on the common portal is retained for seven years only, after which it is archived and no longer available for viewing or download. Archival started with the earliest tax periods of 2017-18 and proceeds month by month, so one further month of data drops off the portal every month. A supplier can reduce taxable value for a post-sale discount under Section 15(3)(b)(ii) only if the recipient has reversed the proportionate input tax credit. Pending a portal facility, CBIC prescribed that the supplier obtain a certificate from the recipient's chartered accountant or cost accountant, with the UDIN, confirming the reversal. Where the tax amount involved in a financial year does not exceed Rs 5 lakh for that recipient, an undertaking or certificate from the recipient itself suffices.

Practical effect: Before issuing GST credit notes for target or turnover discounts, collect the buyer's reversal certificate or undertaking, as officers routinely ask for it during audit.

If I lose the first appeal, what does it cost to go to the GST Appellate Tribunal?
An appeal to the GST Appellate Tribunal requires payment of the admitted dues in full plus an additional pre-deposit of 10 percent of the disputed tax, over and above the 10 percent already paid at the first appeal stage. Following the Finance (No. 2) Act 2024 amendments effective 1 November 2024, this additional deposit was reduced from the earlier 20 percent, and is capped at Rs.20 crore each under CGST and SGST. From 22 September 2025, hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, and accommodation above Rs.7,500 attracts 18 percent with input tax credit. The earlier 12 percent slab for mid-range rooms was abolished in the rate rationalisation. Tax applies on the actual transaction value charged, so a discounted rate below Rs.7,500 falls in the 5 percent bracket even if the printed tariff is higher. Hotels should reconfigure billing software slab-wise and watch the ITC restriction on the 5 percent category, which changes costing materially.
By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. In simple terms, the invoice must travel with the goods; a lorry leaving your Pallavaram godown without an invoice is exposed to detention even if the e-way bill exists.
