A five-judge Bench held that circulars issued by the Board cannot prevail over the statute, and are not binding on courts. Where the Supreme Court or a High Court has declared the law on an issue, that declaration prevails and any contrary circular ceases to have effect. A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.
Practical effect: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Responding to widespread compliance difficulty, this notification amended Notification 08/2017-Central Tax (Rate) to remove the daily Rs 5,000 limit and exempt all intra-State supplies of goods or services received by a registered person from an unregistered supplier from tax under section 9(4), up to 31 March 2018. In effect it suspended the unregistered-purchase reverse charge entirely rather than merely raising the threshold.
