The Supreme Court laid down the "clean slate" principle. Once a resolution plan is approved by the adjudicating authority under the Insolvency and Bankruptcy Code, all claims not forming part of that plan stand extinguished. This expressly covers dues of the Central Government, State Governments and local authorities, including indirect tax dues. No creditor can afterwards initiate proceedings for a claim that was not lodged and dealt with in the plan.
What to do about it: A Chennai company that has come out of an approved resolution plan can resist fresh GST or excise demands for pre-plan periods that the department never lodged as a claim.
45th GST Council Meeting, Lucknow — 17 September 2021 · 2021-09-17
The Council decided that the rate changes needed to correct the inverted duty structure in the footwear and textiles sectors, discussed and deferred at an earlier meeting, would be implemented with effect from 1 January 2022. The correction involved moving fabrics, garments and footwear below the earlier value thresholds from 5 per cent up to 12 per cent so that output tax would exceed input tax and refund claims would cease. The Council also set up Groups of Ministers on rate rationalisation and on using technology to improve compliance.
What to do about it: Tamil Nadu's textile and footwear clusters faced a five to twelve per cent increase from January 2022, a decision the Council reversed for textiles on 31 December 2021, the eve of implementation.
Notification No. 20/2019-Central Tax (Rate) dated 30.09.2019 · 2019-09-30
This notification replaced the old declared tariff test for accommodation with the value of supply actually charged. From 1 October 2019 accommodation up to one thousand rupees per unit per day was exempt, above that and up to seven thousand five hundred rupees attracted 12 per cent, and above seven thousand five hundred rupees attracted 18 per cent. It also reduced outdoor catering at premises other than specified premises to 5 per cent without credit and rationalised several job work entries.
Practical effect: Chennai hotels and lodges must apply the rate to the amount actually billed after discount, not to the rack rate printed at the reception.
