Before rejecting it, the proper officer must have a reasonable doubt based on certain material and specific reasons, must communicate those grounds to the importer, and must give an opportunity to explain. Following the 50th GST Council meeting, CBIC clarified that supply of food and beverages at the snack counters of a cinema hall is taxable as restaurant service at 5 per cent without input tax credit, provided it is supplied independently of the cinema exhibition service. Where a ticket and food are clubbed into a single package, the transaction is a composite supply with exhibition as the principal supply and the ticket rate applies to the whole amount.
