Notification No. 2/2017-Central Tax (Rate), dated 28 June 2017 (G.S.R. 674(E)) · 2017-06-28
This companion notification exempted intra-State supplies of listed goods from central tax altogether, covering fresh vegetables and fruit, unbranded cereals and pulses, milk, curd, salt, live animals, human blood, printed books, judicial stamp paper and many agricultural items. Suppliers dealing only in these goods make exempt supplies, cannot claim input tax credit on related purchases, and must reverse credit under Rule 42 where inputs are common. It was superseded with effect from 22 September 2025.
Why this matters: A Chennai trader dealing in exempt goods should not charge GST on them, but must equally accept that input credit on the related expenses is not available.
49th GST Council Meeting, New Delhi — 18 February 2023 · 2023-02-18
The 49th GST Council meeting decided to clear the entire balance of GST compensation dues to states, with the Centre releasing Rs 16,982 crore for June 2022 from its own resources pending cess collections. The Council also approved release of admissible final compensation to states that had furnished revenue figures certified by their Accountant General. This closed the five-year compensation window promised to states at the launch of GST, while cess collections continued to service the back-to-back loans taken during COVID.
Why this matters: Compensation cess on items like aerated drinks, coal and motor vehicles continued to apply to fund loan repayment, so businesses dealing in cess goods had to keep charging it.

The Supreme Court held that refund of indirect taxes must ordinarily be claimed through the machinery provided in the taxing statute and within the limitation prescribed there. Crucially, it held that a refund cannot be granted where the claimant has passed on the tax burden to the buyer, as that would result in unjust enrichment. The claimant must prove that the incidence of tax was borne by him.
