Where an unregistered person has borne GST on a flat booking or a long term insurance policy that is later cancelled, and the supplier can no longer issue a credit note because the time limit under Section 34 has expired, the buyer may claim the refund directly. The circular prescribes obtaining a temporary registration on the common portal using PAN, and filing FORM GST RFD-01 under the prescribed category with the cancellation document and proof of payment, subject to the minimum refund threshold.
How we apply it: A Chennai homebuyer whose builder agreement is cancelled after the credit note window has closed can still recover the GST directly from the department through a temporary registration.

The company supplied business process and back-office services to an overseas group entity under a master services agreement and claimed refund on export of services. The department treated it as an intermediary and rejected the claim. The High Court held that a person who supplies the main service on its own account is not an intermediary merely because the overseas recipient has its own customers, and that a sub-contracting arrangement does not convert the supplier into a broker or agent. The refund rejection was set aside.
Practical effect: Chennai BPO and back-office exporters should hold a master services agreement showing they perform the service themselves rather than arrange it between two other parties.

With effect from 1 August 2019 the GST rate on electrically operated vehicles, including two-wheelers, three-wheelers and cars, was reduced from twelve per cent to five per cent, and chargers and charging stations for such vehicles were brought to the same five per cent rate. Electrically operated vehicles were defined as vehicles running solely on electrical energy from an external source or from batteries fitted to the vehicle. The five per cent rate on electric vehicles has survived every subsequent restructuring.
