This notification appointed 1 October 2018 as the date on which section 51 of the CGST Act, dealing with tax deduction at source, came into force, and specified the classes of deductors covered, broadly government departments and establishments, local authorities, government agencies and specified public sector undertakings and bodies. The deduction is at one per cent of the taxable value where the contract value exceeds Rs 2.5 lakh.
What to do about it: A Chennai supplier holding government or public sector contracts has faced GST TDS since October 2018, and must claim the credit reflected in FORM GSTR-2A against its output liability.

Invoices had been raised showing the GSTIN of a group company instead of the actual recipient, which prevented the recipient from claiming credit. The High Court held the mistake was bona fide and inadvertent, applied Circular No. 183/15/2022-GST, and directed the authorities to permit rectification of the invoices and the corresponding returns for 2017-18 and 2018-19, and extended the same benefit to 2019-20 taking a justice-oriented approach.
What it means for you: A wrong GSTIN or similar clerical error in old invoices is not necessarily fatal — a rectification request supported by this judgment and Circular 183 is worth pursuing.

Following widespread demands computing interest on the gross tax liability of a late GSTR-3B, ignoring the credit balance available, the Council recommended that interest under Section 50 be charged only on the net cash tax liability, with retrospective effect from 1 July 2017. This was given effect through the proviso to Section 50(1) inserted by the Finance Act, 2021 and notified retrospectively, and it neutralised thousands of interest demands raised on gross turnover across the country.
What to do about it: If you have received an interest demand computed on gross output tax for a late return, the net cash liability principle from this meeting is usually a complete answer.
