The Board settled several goods classification disputes following the 47th GST Council meeting. It confirmed that electrically operated vehicles attract the five per cent rate whether or not they are fitted with a battery pack at the time of supply, and that treated sewage water is exempt because the exclusion for purified water does not extend to it. Rates on fly ash bricks and blocks and on certain by-products of milling of pulses were also clarified.
What to do about it: Chennai dealers in electric vehicles and construction materials should check their invoicing against this circular, since past classification errors are a common audit finding.
Notification No. 38/2023-Central Tax · 2023-08-04
The CGST (Second Amendment) Rules, 2023 inserted Rule 88D, under which the portal auto-intimates a taxpayer in Form DRC-01C when ITC claimed in GSTR-3B exceeds that available in GSTR-2B beyond the prescribed limit. The taxpayer must pay the difference or explain it within seven days, failing which the next GSTR-1 is blocked. The rules also tightened Rule 10A, requiring bank account details within thirty days of registration or before filing GSTR-1, with suspension for default.
Why this matters: Monitor the 2B-versus-3B gap every month, because DRC-01C is system-generated and ignoring it freezes outward supplies filing; also furnish bank details immediately after registration.
GSTN Advisory, 2023 — geocoding of the principal place of business enabled for all States and Union Territories · 2023
GSTN rolled out a geocoding facility that converts the address of the principal place of business into map coordinates, so the location on the registration certificate can be verified against the ground position. After a pilot in a few states, the functionality was extended to normal, composition, casual, SEZ and input service distributor taxpayers in every State and Union Territory during 2023, and geocoding of additional places of business followed. Geocoding does not change the address recorded in the registration.
Practical effect: Complete geocoding for your Chennai premises and any godown, as an unverified address can delay amendments, refunds and physical verification clearance.
