This notification appointed 1 July 2017 as the date on which the remaining provisions of the Central Goods and Services Tax Act, 2017 came into force, that is, all the sections not already notified by Notification 01/2017-Central Tax. From this date the levy under section 9, the input tax credit provisions, the return, payment, refund, assessment, audit, demand and appeal machinery all became operative.

Why this matters: For a Chennai business, 1 July 2017 is the dividing line, transactions before it are governed by VAT, service tax and excise, and transactions from that date by GST.

Merely having credit in the electronic ledger does not by itself stop interest running on a late return

India Yamaha Motor (P) Ltd v. Assistant Commissioner — Madras High Court, W.P. No. 19044 of 2019, decided 29 August 2022 (Anita Sumanth J.) · 2022-08-29

The taxpayer argued that because credit was sitting in its electronic credit ledger, no interest should arise on delayed returns. The Madras High Court largely rejected this, confirming an interest demand of about Rs. 1.19 crore and holding that credit is set off against output tax only when it is actually debited at the time the return is filed. Availability of a credit balance, without an accompanying return, does not amount to discharge of tax.

What to do about it: Sitting on an unused credit balance is no defence to interest — the return must actually be filed and the credit debited for the liability to be treated as discharged.

Electrical wiring harness classified as insulated wire, not a vehicle part

WABCO India Ltd - AAR Tamil Nadu, Order No. TN/10/AAR/2018, dated 27 September 2018 · 2018-09-27

The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

What to do about it: Chennai auto component makers should classify by the tariff description of the article itself, not by the vehicle it eventually goes into.

There is no outer time limit on issuing a debit note itself. Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. Section 17(5) blocks input tax credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, so credit on GST paid for installing machinery, equipment or apparatus fixed to earth remains available. The block does not apply within the construction chain itself: a sub-contractor's works contract service supplied to the main contractor is creditable for the main contractor, since it is used for an onward works contract supply. Classifying civil costs correctly during a project saves disputes at audit.
How are B2B and B2C invoices reported differently in GST returns?
B2B invoices, meaning supplies to registered buyers, are reported invoice by invoice in Table 4 of GSTR-1 with the buyer's GSTIN, so each one flows into that buyer's GSTR-2B for credit. B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. This is why capturing the buyer's GSTIN correctly at billing matters so much; an invoice keyed as B2C by a cashier gives the registered buyer no credit and triggers correction requests later.
Our Agaram factory hires lorries through a transport agency. Who pays the GST?
Under the reverse charge entry, when a GTA that has not opted for forward charge provides service to specified recipients, the recipient pays the 5 percent tax. Specified recipients include factories, registered persons, body corporates, partnership firms including AOPs, co-operative societies and casual taxable persons. Your factory therefore pays 5 percent in cash through GSTR-3B, reports it in the reverse charge tables, and claims the same amount as input tax credit since freight is a business expense. Confirm from the transporter's invoice or declaration whether it has opted for forward charge, because paying RCM on an FCM invoice creates double taxation. Swiggy and Zomato pay the GST on my restaurant orders. How do I show these sales in my returns?
Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. Is there a late fee for filing GSTR-1 after the 11th?
Yes. Late fee for GSTR-1 is Rs.50 per day of delay, and Rs.20 per day where there are no outward supplies, subject to caps linked to your turnover. Is there a late fee if I delay the monthly PMT-06 payment under QRMP?
No late fee applies to a delayed PMT-06 deposit, because late fee is linked only to returns. However, interest at 18 percent per annum is payable on the shortfall for the delay period. Note that if you used the fixed sum method and paid the pre-filled 35 percent amount on time, no interest applies for the first two months even if actual liability was higher, provided the balance is paid in the quarterly GSTR-3B by its due date. Late fee does apply if the quarterly GSTR-1 or GSTR-3B itself is filed late.
Can my company claim ITC on a car purchased for business use, and what about its insurance and repairs?
Generally no. Section 17(5)(a) blocks credit on motor vehicles for transporting persons with approved seating up to thirteen including the driver, even when used for business, unless you are in the business of further supplying such vehicles, transporting passengers, or imparting driver training. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. A Agaram trading company buying a delivery van claims full credit; the director's sedan gets none. Classify each vehicle before claiming.
What is the difference between GSTR-2A and GSTR-2B, and which one should I follow?
GSTR-2A is a dynamic statement that keeps changing as suppliers file or amend their returns, so the same month's data can look different on different dates. GSTR-2B is a static statement generated on the 14th of each month, capturing supplier filings between cut-off dates, and it never changes afterwards. The law ties your ITC eligibility to GSTR-2B, and GSTR-3B auto-populates from it, so 2B is the statement to reconcile against for monthly claims. GSTR-2A remains useful for tracing when an invoice was actually uploaded, which helps in replying to departmental queries about earlier periods.
Is the late fee charged on delayed returns the same thing as a penalty?
No, they are legally distinct. Late fee under Section 47 is an automatic, fixed daily charge for filing a return after its due date, computed by the portal and payable in cash before the return is accepted; no officer discretion or notice is involved. Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
I am a composition dealer. Which returns apply to me and when?
Composition taxpayers do not file GSTR-1 or GSTR-3B. Instead, you pay tax every quarter through statement CMP-08, due by the 18th of the month following the quarter, and file one annual return, GSTR-4, by 30 June following the financial year. The scheme is available for turnover up to Rs.1.5 crore for goods, with a separate 6 percent scheme for service providers up to Rs.50 lakh. My footwear shop sells chappals at Rs.300 and shoes at Rs.4,000 on the same bill. How do I invoice this?
One invoice can comfortably carry both rates. Each pair is tested against the Rs.2,500 sale-value threshold independently, so the chappals are billed at 5% and the Rs.4,000 shoes at 18%, as separate line items under their footwear HSN codes in Chapter 64. Your GSTR-1 HSN summary will then show turnover split across the two rates. Ensure the billing software picks the rate from the item price automatically rather than from a fixed product master, because the same article sold at different price points can legitimately fall in different slabs. What are the GST rates on gold, silver and diamond jewellery?
The special rates on precious metals were retained in the GST 2.0 restructuring. Gold, silver and articles of jewellery attract 3 percent GST, rough and unworked diamonds attract 0.25 percent, and jewellery making charges billed separately attract 5 percent. When a jeweller bills a customer, the metal value and making charges can appear as separate line items with their respective rates on the same tax invoice. What is the GST rate on a works contract for a commercial building?
Under GST, a works contract relating to immovable property is treated wholly as a supply of services, and the standard rate is 18 percent on the contract value, with the contractor eligible for input tax credit on cement, steel and other inputs. This applies to construction, fabrication, erection, repair and renovation contracts for factories, offices and commercial buildings. The old VAT-plus-service-tax splitting of material and labour is gone; one rate applies to the whole consideration. Contractors should also note that free-issue materials supplied by the client can affect valuation, so contract drafting deserves attention before quoting.
I declare income under Section 44ADA. Does that mean I am exempt from GST?
No, this is a common myth. Section 44ADA is a presumptive taxation scheme under the Income Tax Act that lets professionals declare fifty percent of gross receipts as income; it has nothing to do with GST. GST liability depends solely on aggregate turnover crossing the registration threshold and the nature of your supplies. In fact, the two departments now cross-match data, so gross receipts reported in your ITR and Form 26AS that exceed the GST turnover you declared are a known trigger for notices. Treat the two laws as parallel obligations, each with its own limits and filings.
