Circular No. 248/05/2025-GST · 2025-03-27
Issued alongside the Rule 164 amendment, this circular settles the position that tax already paid through GSTR-3B before 1 November 2024 towards a disputed demand counts as payment for the Section 128A waiver, even though Rule 164 otherwise contemplates payment through Form DRC-03 or against the demand order. It gives field formations the procedural guidance for accepting such earlier return-based payments when processing SPL-01 and SPL-02 applications.
Practical effect: Do not abandon an amnesty application merely because the tax was paid earlier through returns rather than DRC-03; that payment counts towards the waiver.
Notification No. 76/2020-Central Tax · 2020-10-15
CBIC notified the GSTR-3B due dates for the six months from October 2020 to March 2021. Taxpayers with aggregate turnover of Rs 5 crore or more in the preceding financial year filed by the 20th of the following month. Taxpayers below that threshold filed by the 22nd or the 24th depending on the State in which their principal place of business was located, with Tamil Nadu falling in the 22nd group. It ceased to matter from January 2021, when the quarterly scheme and the rewritten Rule 61 took over the return calendar.
What to do about it: For the 2020-21 comparison periods, a Chennai taxpayer below Rs 5 crore was due on the 22nd, which matters when interest is computed on a delayed return of that year.
State of Karnataka v. Ecom Gill Coffee Trading (P) Ltd — Supreme Court, 2023 · 2023-03-13
Under Section 70 of the Karnataka VAT Act, the Supreme Court held that the dealer claiming input tax credit bears the burden of proving the transaction actually took place — producing invoices and payment by cheque is not enough. The dealer should establish the seller's particulars, actual movement of goods, freight and delivery details. Though a VAT ruling, GST officers routinely apply this standard while testing ITC claims in scrutiny and audits.
What to do about it: Maintain a complete evidence trail for every purchase — transport documents, e-way bills, weighment slips and payment proof — because invoices alone will not save ITC in a dispute.
