Following the 55th GST Council meeting, fortified rice kernel classifiable under heading 1904 was placed at five per cent irrespective of end use, removing the earlier distinction based on whether it was supplied for public distribution. The same notification recast the definition of pre-packaged and labelled so that it clearly covers commodities intended for retail sale in packs of not more than twenty-five kilograms or twenty-five litres that must bear declarations under the Legal Metrology Act, 2009.
Why this matters: Rice millers and food processors supplying fortified rice kernel charge five per cent from 16 January 2025 whoever the buyer is.

The Board settled several goods classification disputes following the 47th GST Council meeting. It confirmed that electrically operated vehicles attract the five per cent rate whether or not they are fitted with a battery pack at the time of supply, and that treated sewage water is exempt because the exclusion for purified water does not extend to it. Rates on fly ash bricks and blocks and on certain by-products of milling of pulses were also clarified.
What it means for you: Chennai dealers in electric vehicles and construction materials should check their invoicing against this circular, since past classification errors are a common audit finding.

Consignments were detained because the e-way bills accompanying them had expired. The Court directed immediate release on furnishing a bank guarantee and, importantly, directed the assessing officer to consider whether the lapse was a substantive violation or only a technical breach, having regard to Sections 122, 125 and 126 of the CGST Act. Adjudication was to be completed within four weeks, with amounts already remitted by the transporter adjusted against the final determination.
How we apply it: A Chennai consignor whose goods are held for a stale e-way bill can seek release against security while pressing that Section 126 requires leniency for minor procedural lapses.
