Printing leaflets on the printer's own paper attracts 18 percent

Coronation Arts Crafts - AAR Tamil Nadu, Advance Ruling No. 19/ARA/2022, dated 31 May 2022 · 2022-05-31

A printing house printed leaflets and similar material using content supplied by the customer but paper, ink and other physical inputs of its own. It asked for the correct classification and rate. The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.

Interest on delayed GST payment to be charged on net cash liability, retrospectively from 1 July 2017

39th GST Council Meeting, New Delhi — 14 March 2020 · 2020-03-14

Following widespread demands computing interest on the gross tax liability of a late GSTR-3B, ignoring the credit balance available, the Council recommended that interest under Section 50 be charged only on the net cash tax liability, with retrospective effect from 1 July 2017. This was given effect through the proviso to Section 50(1) inserted by the Finance Act, 2021 and notified retrospectively, and it neutralised thousands of interest demands raised on gross turnover across the country.

Practical effect: If you have received an interest demand computed on gross output tax for a late return, the net cash liability principle from this meeting is usually a complete answer.

Notification No. 2/2017-Central Tax (Rate), dated 28 June 2017 (G.S.R. 674(E)) · 2017-06-28

This companion notification exempted intra-State supplies of listed goods from central tax altogether, covering fresh vegetables and fruit, unbranded cereals and pulses, milk, curd, salt, live animals, human blood, printed books, judicial stamp paper and many agricultural items. Suppliers dealing only in these goods make exempt supplies, cannot claim input tax credit on related purchases, and must reverse credit under Rule 42 where inputs are common. It was superseded with effect from 22 September 2025.

What is the difference between DRC-01A and DRC-01 in GST?
DRC-01A is a pre-show-cause intimation. In Part A the officer communicates the tax, interest and penalty he has ascertained and gives you a chance to pay or explain before formal proceedings begin; you can respond through Part B of the same form. DRC-01, by contrast, is the summary of a formal show cause notice under Section 73 or Section 74, which starts adjudication and must be answered in Form DRC-06. What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. It is commonly used to pay liabilities found during a self-review, to respond to a DRC-01A intimation, to settle audit findings, or to pay dues flagged in scrutiny. Paying through DRC-03 under Section 73 before the notice, along with interest, means no penalty and no notice on that amount. Select the correct cause of payment and period in the form, because a wrongly mapped DRC-03 creates reconciliation trouble later.
How much time does the GST department have to issue a demand under Section 73?
For a Section 73 demand, the adjudication order must be passed within three years from the due date of the annual return for the financial year concerned, and the show cause notice must be issued at least three months before that deadline. For Section 74 fraud cases, the order deadline is five years with the notice issued at least six months earlier. For tax periods from FY 2024-25 onwards, a new common provision in Section 74A applies with its own timelines. Always check limitation first; notices issued beyond these dates can be challenged as time-barred, which ChennaiGST examines in every Chetpet demand case.
Can I use my input tax credit balance to pay a DRC-03 liability?
Partly. The tax component of a DRC-03 payment can be settled from the electronic credit ledger, subject to the usual cross-utilisation rules between IGST, CGST and SGST. However, interest, penalty and late fee can never be paid from credit; those components must come from the electronic cash ledger, so you may need to deposit a challan first. The portal shows both ledger balances on the payment screen and lets you split the utilisation. Planning this split correctly avoids depositing cash unnecessarily when credit is lying idle, which is a routine saving we make for clients every month.
What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Under Section 74 the limit is five years and penalty can equal 100 percent of the tax. Contesting a wrong invocation of Section 74 is often the first line of defence.
I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?
Start with a supplier-wise reconciliation identifying why each credit is missing from GSTR-2A, such as the supplier filing late, quoting a wrong GSTIN or reporting B2B supplies as B2C. For FY 2017-18 and 2018-19, CBIC Circular 183/15/2022 permits proving genuine credits through supplier certificates or CA certificates, which resolves many Chetpet cases. Attach tax invoices, payment proofs and ledger extracts to your DRC-06 reply to establish that the conditions of Section 16 were met. Where a supplier has genuinely defaulted, quantify and pay only that portion through DRC-03 rather than conceding the entire demand.
I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
My three-month appeal deadline has passed. Can I still file a GST appeal?
You have a narrow lifeline. The appellate authority can condone a delay of up to one month beyond the three-month limit if you demonstrate sufficient cause, such as illness or circumstances genuinely beyond control, so file APL-01 immediately with a detailed condonation application and evidence. Beyond three months plus one month, the appellate authority has no statutory power to admit the appeal, and your remaining options shrink to a writ petition before the Madras High Court in fit cases, or any amnesty scheme the government may notify. I discovered an old ASMT-13 order only after the return-filing window closed. What can I do now?
Once the sixty-day window and the further sixty-day extended window under Section 62 have both lapsed, filing the return no longer withdraws the order, and the estimated demand in the liability register becomes recoverable. Your remedy shifts to an appeal in Form APL-01 within three months of the order's communication, with the prescribed pre-deposit, arguing the actual figures from your books against the officer's estimate. Appellate authorities regularly scale down best judgment estimates when the genuine return data is placed on record. My GST status shows suspended. What does that mean for my business in Chetpet?

It depends on the capacity in which the director is paid. CBIC Circular 140/10/2020 settles the position: remuneration to a whole-time or executive director who is an employee, paid as salary with TDS under Section 192, is outside GST entirely as an employer-employee transaction. In contrast, sitting fees, commission and professional charges paid to independent or non-executive directors, typically suffering TDS under Section 194J, are taxable and the company pays 18 percent under reverse charge, claiming ITC. What documents must I prepare for reverse charge purchases from unregistered suppliers?
