The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

Practical effect: Chennai auto component makers should classify by the tariff description of the article itself, not by the vehicle it eventually goes into.

Demand and penalty in fake invoicing cases

The Board explained how demand and penalty apply where invoices are issued without any actual supply. A person who merely issues such an invoice has no output tax liability under Sections 73 or 74, because there is no supply at all, but is liable to penalty under Section 122(1)(ii). A person who takes and utilises credit on such an invoice faces demand and penalty under Section 74, and a person who further passes on that credit is treated the same way.

This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. It is commonly used to pay liabilities found during a self-review, to respond to a DRC-01A intimation, to settle audit findings, or to pay dues flagged in scrutiny. Paying through DRC-03 under Section 73 before the notice, along with interest, means no penalty and no notice on that amount. Select the correct cause of payment and period in the form, because a wrongly mapped DRC-03 creates reconciliation trouble later.

What is self-invoicing under RCM and is there a time limit for it?
When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice.
