CBIC laid down the prerequisites for an intermediary. There must be a minimum of three parties, and two distinct supplies, the main supply between two principals and the ancillary supply of arranging or facilitating it. The supplier must have the character of a broker or agent playing a supportive role, and a person supplying goods or services on his own account on a principal-to-principal basis is not an intermediary. Sub-contracting is expressly excluded, and illustrations are given for software support and marketing services.

Vadivel Pyrotech (P) Ltd v. Assistant Commissioner (ST) — Madras High Court, 2022 · 2022-09-27
The taxpayer was fastened with a demand arising from discrepancies between GSTR-1 and GSTR-3B without being issued a scrutiny intimation in Form ASMT-10. The Madras High Court held that when proceedings originate from scrutiny of returns under Section 61, issuance of ASMT-10 pointing out the discrepancies and seeking an explanation is a mandatory first step; bypassing it vitiates the subsequent assessment. The order was set aside and the matter remitted for fresh action in accordance with law.
Why this matters: Check the procedural chain in any mismatch demand — if no ASMT-10 preceded your DRC-01 in a scrutiny case, the entire proceeding can be challenged.

The liability to pay tax on reverse charge basis on supplies received from unregistered persons, already suspended at the 22nd meeting until 31 March 2018, was deferred further to 30 June 2018. A Group of Ministers was appointed to examine the modalities of implementation so that no inconvenience would be caused to trade and industry. The provision was ultimately never revived in its original form and was replaced by a narrower, notified-goods version at the 28th meeting.
