The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

Practical effect: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.

Director's personal property rent outside reverse charge; cinema food taxed as restaurant service

Circular No. 201/13/2023-GST · 2023-08-01

CBIC clarified that where a director rents out immovable property to the company in his personal capacity rather than as a director, the reverse charge entry for director's services does not apply and the ordinary forward charge rules govern. It also clarified that supply of food and beverages in cinema halls is taxable as a restaurant service at five per cent without input tax credit, unless the sale of the ticket and the food are clubbed as a composite supply with the ticket as the principal supply.

Practical effect: Companies paying rent to a director for personally owned premises need not discharge reverse charge under the director's-services entry, but must check the landlord's registration status.

Acting on the GST Council's decision at its 23rd meeting in Guwahati, this notification restructured the rate on restaurant, eating joint, mess and canteen services. From 15 November 2017 the rate became 5 per cent with the express condition that no input tax credit on goods and services used in supplying the service may be taken. Restaurants located in hotels where the declared tariff of any unit of accommodation was seven thousand five hundred rupees or more continued at 18 per cent with full input tax credit.

What it means for you: A standalone Chennai restaurant charges 5 per cent and must write off all GST on rent, equipment and ingredients as a cost, since no credit is allowed.

Which educational services are actually exempt from GST?
The exemption is confined to an educational institution as defined, meaning one providing pre-school education, education up to higher secondary school or equivalent, education as part of a curriculum for obtaining a qualification recognised by Indian law, or an approved vocational education course. Services by such institutions to their students, and specified input services to schools such as transport, catering and security, are exempt. Everything outside this boundary is taxable: private tuition, test preparation, hobby classes, skill courses without recognised certification, and training by ed-tech companies. I declare income under Section 44ADA. Does that mean I am exempt from GST?
No, this is a common myth.
