A five-judge Bench held that an exemption notification must be interpreted strictly, and the burden of proving entitlement lies on the person claiming it. If there is genuine ambiguity in the wording of an exemption, the benefit of doubt goes to the revenue, not the taxpayer. This overruled the contrary view in Sun Export. The principle applies squarely to GST exemption and concessional rate notifications.

The Chennai company provided management consultancy and detailed project report services to the Chennai Metro Water Supply and Sewerage Board for water related projects. It asked whether the service attracted GST. The Authority held that the supply was a pure service with no supply of goods involved, rendered in relation to a function entrusted to a municipality, and was therefore exempt from GST under the entry covering pure services supplied to government and local authorities.

With effect from 1 January 2021 the Central Goods and Services Tax (Fourteenth Amendment) Rules, 2020 tightened Rule 36(4). Credit in respect of invoices which suppliers had not uploaded in their outward supply statements could be taken only to the extent of five per cent of the eligible credit appearing from uploaded invoices, down from the earlier ten per cent. This was the third stage of the restriction, which had begun at twenty per cent in October 2019 and moved to ten per cent from January 2020.
