Notification No. 6/2022-Central Tax (Rate), dated 13 July 2022 · 2022-07-13
Acting on the 47th GST Council recommendation, this notification rewrote the goods schedule so that curd, lassi, buttermilk, paneer, honey, cereals, pulses, flour, jaggery, puffed rice and similar staples attract five per cent when they are pre-packaged and labelled. The earlier test of whether the goods carried a registered brand name was abandoned, because it had been widely defeated by suppliers voluntarily forgoing brand registration. The change took effect from 18 July 2022.
Why this matters: From July 2022 a Chennai rice or flour dealer selling in labelled retail packs charges five per cent even if the pack carries no registered brand.
49th GST Council Meeting, New Delhi — 18 February 2023 · 2023-02-18
The 49th GST Council meeting decided to clear the entire balance of GST compensation dues to states, with the Centre releasing Rs 16,982 crore for June 2022 from its own resources pending cess collections. The Council also approved release of admissible final compensation to states that had furnished revenue figures certified by their Accountant General. This closed the five-year compensation window promised to states at the launch of GST, while cess collections continued to service the back-to-back loans taken during COVID.
How we apply it: Compensation cess on items like aerated drinks, coal and motor vehicles continued to apply to fund loan repayment, so businesses dealing in cess goods had to keep charging it.

Implementing 55th GST Council decisions, CBIC clarified that penal charges levied by banks and NBFCs for breach of loan terms, which replaced penal interest per RBI directions, are not consideration for any service and attract no GST. It also clarified that RBI-regulated payment aggregators are covered by the exemption for settlement of transactions up to Rs 2,000, and addressed other service-tax positions, regularising past periods on an as-is basis.
What to do about it: Borrowers should not accept GST charged on penal charges by lenders, and merchants using payment aggregators get relief on small-ticket settlement charges.
